In June 2002, Brunner was found guilty by a general court-martial of carnal knowledge and sodomy of a child under 16, in violation of Articles 120 and 125 of the Uniform Code of Military Justice. Brunner was sentenced to 24 months' confinement, with 12 months suspended, and dishonorably discharged. New York State designated Brunner a level 2 sex offender, which required him to register as a sex offender in New York and to keep his registration current. New York state law classifies a level 2 sex offender as one whose risk of repeat offense is moderate. NY Correction Law § 168-k(2).

When released from custody on June 3, 2003, Brunner completed a sex offender registration form, listing his expected residence as Barneveld, New York. On that same form, Brunner acknowledged his duty to notify the New York Department of Criminal Justice Services ("DCJS") in writing of any change of home address no later than ten days after such a move. In August 2003, Brunner filed a change of address form listing his new residence in Rome, New York. DCJS sent Brunner the mandatory annual verification forms at his last-known address in Rome from 2007, 2008, and 2009, but the forms were returned by the post office as undeliverable. On March 9, 2009, the Rome City Court issued a warrant for Brunner, charging him with failure to register. On March 26, 2010, the Rome Police Department asked the U.S. Marshals Service for help finding Brunner. An investigation revealed that Brunner had applied for food stamps and Medicaid under a false name, Christopher Wiatr, listing an address in Utica, New York. The Marshals located Brunner at the address purportedly belonging to Wiatr, and on April 15, 2010, a federal grand jury for the Northern District of New York indicted Brunner for failing to register as required by SORNA.

It was a frighteningly close call for Charles Tubbins. The 23-year-old Buffalo man was already charged with murder and indicted by a grand jury for a crime he did not commit.

All that was required for a wholesale miscarriage of justice was for the plea negotiations to begin, presenting Tubbins with the horrifying options of standing trial or admitting to a crime he didn't commit in hopes of a lesser sentence.

It didn't come to that because DNA evidence found at the crime scene exonerated Tubbins and implicated another man, Ahkeem R. Huffman. To his credit, Erie County District Attorney Frank A. Sedita moved quickly to dismiss the charges, but the case raises the same issues that have led to lengthy prison sentences for other innocent people in Erie County - issues of which law enforcement and the State Legislature are fully aware, but haven't seen fit to address.

Tubbins was ensnared by the same human error that put Anthony Capozzi in prison for rapes he did not commit: witness misidentification. Eyewitness testimony was the only evidence against Tubbins, who, his lawyer noted, has no prior criminal convictions, no history of violence, no prior felony or misdemeanor.

UPON DUE CONSIDERATION, IT IS HEREBY ORDERED, ADJUDGED, AND DECREED that the judgment of the district court is AFFIRMED.

Defendant-appellant Henry Lee Cooper pleaded guilty to one count of failing to update his registration as required by the Sex Offender Registration and Notification Act. See 18 U.S.C. § 2250. The district court imposed a thirty-month sentence, the top of the applicable guidelines range, which Cooper now challenges as both procedurally and substantively unreasonable. We assume the parties' familiarity with the facts and record of prior proceedings, which we reference only as necessary to explain our decision.

Cooper's challenges to the procedural reasonableness of his sentence were not raised below. Therefore, our review is for plain error. United States v. Brennan, 395 F.3d 59, 71 (2d Cir. 2005).

The young woman who told police she was abducted and raped at a Queensbury town park has been charged with falsely reporting the attack after police determined she had been working as a prostitute and had arranged a sexual encounter with a man that night, police said.

The 17-year-old from Glens Falls was charged with misdemeanor counts of prostitution, falsely reporting an incident and making a false written statement to police for her report that she was raped at Hovey Pond Park the night of June 15. Her name is being withheld because of her age.

The man with whom she allegedly met that night, James M. Skidmore, 38, of Moreau, was charged with misdemeanor patronizing a prostitute after Warren County sheriff's officers determined he was the person the teen met that night and that he paid her for sex, authorities said.
