• President Obama has dispatched a delegation this week to The Hague to explore issues involving the United States' possible participation in the International Criminal Court,
• an organization critics charge could be used to prosecute Americans under international legal standards for actions that are not crimes in the U.S.
• Andy Laney of the U.S. State Department confirmed the delegation is comprised of members of the State Department as well as the Defense Department.
• He said they were dispatched on a weeklong trip because of U.S. concerns over how "aggression" is defined internationally.
• "There is an interagency party, half from the State Department, half from the Defense Department, there to engage other delegations on matters of U.S. interest and specifically over our concerns on the definition of the crime of aggression," he said.
• Critics, however, warn that they believe former U.S. war crimes prosecutor Ambassador Stephen Rapp is on a trip that involves more than just the definition of a word.
• "The Obama administration would like the U.S. to be a party to the court," said Brett Schaefer, an international regulatory expert with the Heritage Foundation.
•

• "The Obama administration would like to establish closer ties with the ICC if it turns out the U.S. can join the court.
• The objective here is to address the major objections to the U.S. joining the court," he said.
• White House officials declined to comment.

• The court was introduced to the U.S. when President Bill Clinton signed the Rome Statute in 1998.
• But President George W. Bush pulled the U.S. out in 2003 over concerns that the ICC might prosecute American soldiers for war-crime charges coming from the U.S. campaigns in Iraq and Afghanistan.
• The concern was that the ICC doesn't recognize many of the U.S. Constitution's provisions protecting defendants in criminal trials, such as the right to a trial by jury and protections against double jeopardy.
• "The meeting at The Hague is also in preparation for the Rome Statute's review in May of 2010," Schaefer said.
• "Mr. Rapp is there to find out if (the 108) member states are interested in amending the document to address U.S. concerns. Ambassador Rapp is there to learn how substantial the barriers to the U.S. joining the court actually are."

• Laney admitted it was a change in U.S. direction that prompted the trip.
• "The decision to send Ambassador Rapp reflects the commitment of this administration to engage the international community on issues that affect our foreign policy interests," Laney said.
• Since coming into office, President Obama says he wants the U.S. to join and Secretary of State Clinton says it's unfortunate that the U.S. is not a part of the ICC," Schaefer said.
• "Ambassador Rapp says he wants the U.S. to join the ICC.
• "The previous administration in its early years sought to amend the treaty to alleviate U.S. concerns ... the treaty would intrude on U.S. policy and its obligations overseas," Schaefer said. "That effort failed. So, the Bush Administration in 2003 sent a letter to the Secretary General of the U.N. saying it no longer considered itself bound to the jurisdiction of the ICC."
• Schaefer said the process as it now is set up presents dangers.
• "Israel took action in Gaza earlier this year to attack Hamas and knock out the Hamas rocket launchers in the Gaza Strip," he said. "Israel took enormous cautionary measures to prevent civilian casualties.
• Even though Israel and the Palestinian Authority are not signatory members of the ICC, the ICC is still investigating the Israeli military to see if they can prosecute members of the Israeli Army for war crimes."
• Mathew Staver, lead attorney for Liberty Counsel and dean of Liberty University Law School, said U.S. membership in the ICC would be a mistake.
• "This administration is globalist and transnationalist and wants to bring this country into the global system.
• The U.S. stands to have its citizens being prosecuted by the international court in The Hague and have its citizens come under the world court's jurisdiction," he said.
• Schaefer confirmed Staver's fears.
• "Supposing the U.S. engages in a military action and that action results in civilian casualties. We do an investigation of the matter and find no guilty party. If we are a member of the court, if we are a party to the Rome Statute, the ICC at that point has the opportunity to second-guess us," he said.
• "They may be able to use evidence and they may be able to pursue routes of trial that would not be portable in the U.S. because of the different standards established in the U.S. legal system and the rules set forth in the Rome Statute."
• His warning is that the ICC could, "in essence … come and prosecute U.S. citizens, U.S. soldiers, U.S. officials for actions the U.S. deems entirely lawful."

• He believes the Obama White House will begin the push for ratification after the May 2010 review of the treaty.
• "After the May review is when I believe the administration will seek to go to Congress to make the changes in our system necessary that will allow us to participate in the ICC," he said.
• Staver said Americans should be worried.
• "President Obama definitely wants the U.S. to be a part of a transnational, global system."
• "Everything anyone has ever heard about the globalist system is being promoted by this administration," he said.
• WND columnist David Limbaugh has raised similar concerns.
• "Transnationalists," he wrote, "believe that American judges, in interpreting our Constitution, can resort to this 'community of reason' (foreign laws) to choose between two 'plausible' legal positions."
• It is the global community, he wrote, that such transnationalists "look to" to determine standards.

• In his book, "Global Deception," author Joseph Klein warns that the International Criminal Court is just one building block of a "brave new world" already under way.
• He said the court would have "secret proceedings that would make terrorist trials look open by comparison" and suggested the plan is for them to "take precedence over the U.S. judicial system."

   Controversial legislation gives police sweeping powers of 'pre-emptive' arrest and extends custodial sentences for acts of civil disobedience.
• The Danish parliament today passed legislation which will give police sweeping powers of "pre-emptive" arrest and extend custodial sentences for acts of civil disobedience.
• The "deeply worrying" law comes ahead of the UN climate talks which start on 7 December and are expected to attract thousands of activists from next week.
• Under the new powers, Danish police will be able to detain people for up to 12 hours whom they suspect might break the law in the near future.
• Protesters could also be jailed for 40 days under the hurriedly drafted legislation dubbed by activists as the "turmoil and riot" law. The law was first announced on 18 October.
• The Danish ministry of justice said that the new powers of "pre-emptive" detention would increase from 6 to 12 hours and apply to international activists.
• If protesters are charged with hindering the police, the penalty will increase from a fine to 40 days in prison.
• Protesters can also be fined an increased amount of 5,000 krona (671 Euros) for breach of the peace, disorderly behaviour and remaining after the police have broken up a demonstration.
• The Danish police also separately issued a statement in August (pdf) applying new rules and regulations for protests at the climate conference,
• warning that "gatherings that may disturb the public order must not take place".
• Earlier this month, the Guardian published a letter by environmental activists that described the new law as "deeply worrying" and called for the Danish government to uphold their right to legitimate protest.
• Tannie Nyboe, a spokewoman from campaigning group Climate Justice Action in Denmark, said the new law was designed to control civil disobedience during the summit.
• "These laws are a big restraint in people's freedom of speech and it will increase the police repression for anyone coming to Copenhagen to protest.
• Denmark normally boasts of how open and democratic a country we are. With this law we can't boast about this anymore.
• "It will increase the repression of any protester or activist coming to Copenhagen. This law creates an image of anyone concerned about climate change being a criminal, which will of course also influence the general treatment of any activist who comes into contact with the police or other authorities."
• A Danish justice ministry confirmed that the laws had been passed today and would come into effect before the climate conference starts on 7 December.

• By the authority vested in me as President by the Constitution and the laws of the United States of America, including section 1 of the International Organizations Immunities Act (22 U.S.C. 288), and in order to extend the appropriate privileges, exemptions, and immunities to the International Criminal Police Organization (INTERPOL), it is hereby ordered that Executive Order 12425 of June 16, 1983, as amended, is further amended by deleting from the first sentence the words "except those provided by Section 2(c), Section 3, Section 4, Section 5, and Section 6 of that Act" and the semicolon that immediately precedes them.
• Here’s the text of 2(c), which this EO now has applying to INTERPOL:
• (c) Property and assets of international organizations, wherever located and by whomsoever held, shall be immune from search, unless such immunity be expressly waived, and from confiscation. The archives of international organizations shall be inviolable.
• An INTERPOL branch in the US now cannot be searched, it’s files are not subject to legal subpoena nor discovery. 
• If any branch of government wants to keep documents out of the hands of the court system, just hand them over to INTERPOL until the smoke clears.
• INTERPOL will now be able to maintain files on US citizens.
• By this EO, Obama has conferred diplomatic immunity upon INTERPOL, exemption from being subject to search and seizure by law enforcement, exemption from US taxes, and immunity from FOIA requests, etc.
• Obama just declared INTERPOL records immune from search and seizure — "The archives of international organizations shall be inviolable."

• Yesterday, it was brought to my attention by Pierre Legrand that President Obama signed an Executive Order on December 17th that no one and I mean no one, reported on.
• As horrifying as the health care legislation is and I personally believe it is worthy of revolt, this Executive Order has the potential to be monstrous.
• Here is the Executive Order:

• Nudge, nudge folks… This seems a minor change but let us break it out for you as we see it. Let’s look at the section from Executive Order 12425.

• Here’s the text of 2(c), which this Executive Order now has applying to Interpol:

  (c) Property and assets of international organizations, wherever located and by whomsoever held, shall be immune from search, unless such immunity be expressly waived, and from confiscation. The archives of international organizations shall be inviolable.
• Their premises or staff can no longer be searched either. Their files are not subject to legal subpoena or discovery. Our government could just hand documents and files over to Interpol and Americans would no longer have access to them.
• This now says that Interpol is no longer subject to the Freedom of Information Act.
• Interpol can legally keep files now on all citizens of the US with no right to redress.
• Interpol headquarters in the US is currently headquartered in the Department of Justice.
• In reality, we have just handed over our sovereignty.
• A ‘separate’ Interpol agency has been created in the DOJ – let that sink in for a moment.
• Interpol has been granted diplomatic immunity now by Obama – they have exemption from being subject to search and seizure by law enforcement, US taxes and immunity from FOIA requests, etc.
• This action could also be used to divulge American military secrets and a whole host of horrific practices having to do with going after our military.
• It’s the road to internationalism on steroids.
• I contend this is the foundation for an international governing and policing body. A modern day SS here in the US if you like.
• Remember how Obama wanted to create a civilian police force? Well, it’s here, just from a direction I never saw it coming from.
• I really believe you will see Interpol police forces on US soil in the near future.
• It will resemble the Gestapo and their intelligence gathering techniques. This police force would not be subject to our normal Constitutional oversights – remember, no search and seizure etc.
• You have to admire the evil genius behind all this. Just stunning.

  It is well to know who these people are, and where they’ve been. Though the expression “modern day SS” sounds like a hyperbolic metaphor, an examination of Interpol’s roots shows that it is, in fact, more literally true than that.
• I was in Europe in 1973 when an expose was published, revealing that many, if not all, of the presidents of Interpol from the late 1930s or early ’40s until at least 1972 were Nazi Gestapo and SS officers.
• Reinhard (”The Hangman”), Heydrich (also head of Nazi SS Intelligence Service) and Gestapo chief Ernst Kaltenbrunner.
• By 1942 Interpol was consolidated with the Nazi Central Police, run by the Gestapo.
• As the Nazis invaded cities throughout Europe, police files from each were seized and evidently integrated into Interpol’s files.
• In 1972 the sitting Interpol President was Paul Dickopf, former Nazi SS officer (SS #337259).
• The source on this? The Simon Wiesenthal Center. Simon Wiesenthal is pretty much the most famous of the post-war Nazi hunters, having impressively thorough files.
• Interpol isn’t just any old bunch of thugs. They are rooted in one of the most effective and ruthless gang of thugs anywhere, ever.
• If there is anything at all that can be done to nullify this Executive Order, it needs to be done soonest.
• The idea of an American President enlisting the aid of both old Communists and old Nazis to bring about the fall of the United States is the stuff of rejected bad novel plots.
• No one would ever buy a plot that cheesy. I mean, really, would you go see a movie about a President who rose to power through voter fraud and union thuggery, and then brought in the survivors of the two most virulent enemies the country has ever had in order to deliver the knock-out punch to our culture and nation?
• No, you wouldn’t. It would be the stupidest piece of modern fiction on record. It’s totally unbelievable as a story line.
• Yeah, it’s really lame fiction.
• It makes for even worse reality.
• Interpol are not the good guys. Nothing good can come from giving them any domain at all in our country.
• Before we let you go, I want to remind you of some of the ‘civilian army’ items that we have showcased before:
• Remember, Obama did this while no one was looking and while they were distracted.
• No media outlet is looking into it. No one is ringing alarm bells. This is happening and it is here.
• The Trojan Horse of health care for all was definitely a pig with lipstick. The Interpol Executive Order is a shiny Trojan Horse that has the potential to grind America beneath Obama’s bootheel…
