Abstract: The decision in Lucasfilm Ltd & Ors v Ainsworth & Anor [2008] EWHC 1878 (Ch) provides valuable guidance with regard to the limits of what rights may exist in highly stylised costumes and props which also serve to fulfil utilitarian or functional purposes. In Lucasfilm, the claimants (Lucas) brought an action based on copyright infringement, passing off and a claim for breach of confidence in relation to helmets and armour which the defendants (Ainsworth) had prepared for the 1977 film, Star Wars, and had begun selling replica versions of in 2004.
