That the person being discussed is a covert agent as defined by 50 USC 426 is an element. In this instance, Valerie Plame did not meet the statutory definition and so there was no mistake in the Plame case.

• After more than 20 years as a prosecutor, one would expect reference to statutory law would include (hyperlink) citations to those statutes. Also, to omit 4 elements from the discussion, one which showed the fallacy of the entire premise demonstrates to me a lack of honesty on the part of the author. - John StGeorge on 2010-08-22
