It appears that Dunn was not qualified, under the law, to run for the office.
Barnett's new case, filed in Superior Court of California in Sacramento, explains that to be eligible to run for secretary of state, the state's chief elections officer, "a declared and a nominated candidate shall under [Paragraph] 201 of the California Elections Code 'be a registered voter and otherwise qualified to vote for the office at the time nomination papers are issued.'"
But the lawsuit alleges Dunn filed a registration to vote in California and to affiliate with the California Republican Party March 13, 2009. It explains that state law requires that a candidate not have been "registered as affiliated with a qualified political party other than that political party the nomination of which he seeks within 12 months."
The complaint explains that Dunn on Nov. 5, 2009, "who had been registered and enrolled/affiliated with the Florida Democratic Party within 12 months, filed the declaration for his candidate for the California Republican Party nomination."
Most of this is nonsense and meaningless when addressing the eligibility of Obama. Under US law, parents cannot change the birth status of their minor child. In my day, a long long time ago, the authorities running a background check for a high level security clearance would have a fit if the long form birth certificate said 'II" and the applicant put down "Jr." We had a fellow whose parents never put a first name on the birth certificate. It was registered with a simple "X" in that field. That presented a problem. Another had parents from Italy. Since he was the eldest son of the eldest son, he was the new "Don." The authorities had no sense of humor and insisted that his first name was "Don."
This is the question that needs to be answered. Generally, one uses a long form birth certificate to obtain the first passort and the old passport to get a new one. We know that Obama was first on his mother's passport which should have required the long form birth certificate and a simple request to move him from her passport to his own. My son was 2 months old when I applied for his first passport. Since I had not known him for 5 years, I could not sign for him. Since I had known him since birth, I could.
The judge ruled that the accused had been accused and that should be sufficient for a guilty verdict?
