Time To Scrap All Music Industry Licensing Schemes | Techdirt

It's impossible to be a legal innovator in online music these days. No matter what you do, you will run afoul of some kind of music licensing issue. That's because of the way that copyright law is designed. Basically, each time some new technology comes along that doesn't fit with the way copyright law used to work, the copyright holders run to Congress and demand yet another new "right" to be included in copyright -- and anyone who wants to do anything has to now pay for yet another license to cover that right. The end result is a comical house of cards that no one can actually figure out

We've built a copyright system by having politicians incorrectly accept the screaming complaints of legacy industries every time some new technology comes along. So they add another layer of complexity to that house of cards, and we've now reached the point where it's impossible to innovate legally -- and even doing basic creativity puts you at significant risk. Yet, there's ample evidence that none of this is actually needed for musicians to make a living making music. It's time to recognize this and look to just wipe out all of these unnecessary legacy artifacts of a dead system, and clear the decks to let real innovation thrive.

Right now, Apple doesn't make money on iTunes, but it loves the service because it has helped the company sell nearly 200 million iPods and some 13 million iPhones to date. Apple would be interested in developing an iNews service only if it would move more iPods (or a new tablet version, rumored to be in the works). Given the newspaper industry's track record of convincing readers to pay up, it's doubtful newspapers would be attractive enough to lure in new Apple customers. (By most estimates Amazon has sold only 500,000 Kindles since its launch, hardly a number to brag about.) The sad fact is that journalism and books, while culturally invaluable, don't have the consumer demand that music and videos do. "The only places nickel and dimes work—ring tones, music and in-game currency—is when there's an end-to-end monopoly," notes Clay Shirky, an adjunct professor of new media at NYU and an early micropayment critic.
But the monopoly newspapers once commanded has been obliterated by the Internet. How would a newspaper that adopted a micropayment system compete with outlets that remained free? If the Times went behind a micropayment pay-wall, couldn't the Washington Post undercut them and attract a lot of readers seeking free, quality news?

Nice engaging power point presentation. I agree with your presentation. The only thing i would add to it is that the free music model might only work for more established bands with a rabid following. NIN can sell $300 sets but i doubt that would work for an indie band. So, not unlike any other business plan, it isn't bullet proof and there are always conditions.

So, I think we've addressed that issue. And, in the presentation, I thought I made it clear that when I was talking about small bands doing this, it wasn't about selling $300 box sets. But about connecting in other ways, as all the examples above have shown.
