Blackwater Founder Implicated in Murder

Susan Burke, a private attorney working in
conjunction with the Center for Constitutional Rights, is suing
Blackwater in five separate civil cases filed in the Washington, DC,
area.
They were recently consolidated before Judge T.S. Ellis III of the
Eastern District of Virginia for pretrial motions. Burke filed the
August 3 motion in response to Blackwater's motion to dismiss the case.

- Blackwater asserts that Prince and the company are innocent of any
  wrongdoing and that they were professionally performing their duties on
  behalf of their employer, the US State Department.
- The former employee, identified in the court documents as "John Doe #2,"
  is a former member of Blackwater's management team, according to a
  source close to the case.
- Doe #2 alleges in a sworn declaration that,
  based on information provided to him by former colleagues, "it appears
  that Mr. Prince and his employees murdered, or had murdered, one or more
  persons who have provided information, or who were planning to provide
  information, to the federal authorities about the ongoing criminal
  conduct."
- John Doe #2 says he worked at Blackwater for four years; his
  identity is concealed in the sworn declaration because he "fear[s]
  violence against me in retaliation for submitting this Declaration."
- He
  also alleges, "On several occasions after my departure from Mr. Prince's
  employ, Mr. Prince's management has personally threatened me with death
  and violence."
- In a separate sworn statement, the former US marine who worked for
  Blackwater in Iraq alleges that he has "learned from my Blackwater
  colleagues and former colleagues that one or more persons who have
  provided information, or who were planning to provide information about
  Erik Prince and Blackwater have been killed in suspicious
  circumstances."
- Identified as "John Doe #1," he says he "joined
  Blackwater and deployed to Iraq to guard State Department and other
  American government personnel."
- It is not clear if Doe #1 is still
  working with the company as he states he is "scheduled to deploy in the
  immediate future to Iraq." Like Doe #2, he states that he fears
  "violence" against him for "submitting this Declaration." No further
  details on the alleged murder(s) are provided.
- "Mr. Prince feared, and continues to fear, that the federal authorities
  will detect and prosecute his various criminal deeds," states Doe #2.
  "On more than one occasion, Mr. Prince and his top managers gave orders
  to destroy emails and other documents. Many incriminating videotapes,
  documents and emails have been shredded and destroyed."
- The Nation cannot independently verify the identities of the two
  individuals, their roles at Blackwater or what motivated them to provide
  sworn testimony in these civil cases. Both individuals state that they
  have previously cooperated with federal prosecutors conducting a
  criminal inquiry into Blackwater.
- "It's a pending investigation, so we cannot comment on any matters in
  front of a Grand Jury or if a Grand Jury even exists on these matters,"
  John Roth, the spokesperson for the US Attorney's office in the District
  of Columbia, told The Nation.
- Asked specifically about whether there is a criminal
  investigation into Prince regarding the murder allegations and other
  charges, Roth said: "We would not be able to comment on what we are or
  are not doing in regards to any possible investigation involving an
  uncharged individual."
- The Nation repeatedly attempted to contact spokespeople for
  Prince or his companies at numerous email addresses and telephone
  numbers. When a company representative was reached by phone and asked to
  comment, she said, "Unfortunately no one can help you in that area."
- The
  representative then said that she would pass along The Nation's
  request. As this article goes to press, no company representative has
  responded further to The Nation.
- Doe #2 states in the declaration that he has also provided the
  information contained in his statement "in grand jury proceedings
  convened by the United States Department of Justice."
- Federal
  prosecutors convened a grand jury in the aftermath of the September 16,
  2007, Nisour Square shootings in Baghdad, which left seventeen Iraqis
  dead. Five Blackwater employees are awaiting trial on several
  manslaughter charges and a sixth, Jeremy Ridgeway, has already pleaded
  guilty to manslaughter and attempting to commit manslaughter and is
  cooperating with prosecutors.
- It is not clear whether Doe #2 testified
  in front of the Nisour Square grand jury or in front of a separate grand
  jury.
- The two declarations are each five pages long and contain a series of
  devastating allegations concerning Erik Prince and his network of
  companies, which now operate under the banner of Xe Services LLC.

- Among
  those leveled by Doe #2 is that Prince "views himself as a Christian
  crusader tasked with eliminating Muslims and the Islamic faith from the
  globe":
- To that end, Mr. Prince intentionally deployed to Iraq
  certain men who shared his vision of Christian supremacy, knowing and
  wanting these men to take every available opportunity to murder Iraqis.
  Many of these men used call signs based on the Knights of the Templar,
  the warriors who fought the Crusades.
- Mr. Prince operated his companies in a manner that encouraged and
  rewarded the destruction of Iraqi life. For example, Mr. Prince's
  executives would openly speak about going over to Iraq to "lay Hajiis
  out on cardboard." Going to Iraq to shoot and kill Iraqis was viewed as
  a sport or game. Mr. Prince's employees openly and consistently used
  racist and derogatory terms for Iraqis and other Arabs, such as
  "ragheads" or "hajiis."
- Among the additional allegations made by Doe #1 is that "Blackwater was
  smuggling weapons into Iraq."
- He states that he personally witnessed
  weapons being "pulled out" from dog food bags. Doe #2 alleges that
  "Prince and his employees arranged for the weapons to be polywrapped and
  smuggled into Iraq on Mr. Prince's private planes, which operated under
  the name Presidential Airlines," adding that Prince "generated
  substantial revenues from participating in the illegal arms trade."
- Doe #2 states: "Using his various companies, [Prince] procured and
  distributed various weapons, including unlawful weapons such as sawed
  off semi-automatic machine guns with silencers, through unlawful
  channels of distribution." Blackwater "was not abiding by the terms of
  the contract with the State Department and was deceiving the State
  Department," according to Doe #1.
- This is not the first time an allegation has surfaced that Blackwater
  used dog food bags to smuggle weapons into Iraq.
- ABC
  News's Brian Ross reported in November 2008 that a "federal grand
  jury in North Carolina is investigating allegations the controversial
  private security firm Blackwater illegally shipped assault weapons and
  silencers to Iraq, hidden in large sacks of dog food." Another former
  Blackwater employee has also confirmed this information to The
  Nation.
- Both individuals allege that Prince and Blackwater deployed individuals
  to Iraq who, in the words of Doe #1, "were not properly vetted and
  cleared by the State Department."
- Doe #2 adds that "Prince ignored the
  advice and pleas from certain employees, who sought to stop the
  unnecessary killing of innocent Iraqis."
- Doe #2 further states that some
  Blackwater officials overseas refused to deploy "unfit men" and sent
  them back to the US. Among the reasons cited by Doe #2 were "the men
  making statements about wanting to deploy to Iraq to 'kill ragheads' or
  achieve 'kills' or 'body counts,'" as well as "excessive drinking" and
  "steroid use."
- However, when the men returned to the US, according to
  Doe #2, "Prince and his executives would send them back to be deployed
  in Iraq with an express instruction to the concerned employees located
  overseas that they needed to 'stop costing the company money.'"
- Doe #2 also says Prince "repeatedly ignored the assessments done by
  mental health professionals, and instead terminated those mental health
  professionals who were not willing to endorse deployments of unfit men."
- He says Prince and then-company president Gary Jackson "hid from
  Department of State the fact that they were deploying men to Iraq over
  the objections of mental health professionals and security professionals
  in the field," saying they "knew the men being deployed were not
  suitable candidates for carrying lethal weaponry, but did not care
  because deployments meant more money."
- Doe #1 states that "Blackwater knew that certain of its personnel
  intentionally used excessive and unjustified deadly force, and in some
  instances used unauthorized weapons, to kill or seriously injure
  innocent Iraqi civilians."
- Doe #1 states that he "personally observed multiple
  incidents of Blackwater personnel intentionally using unnecessary,
  excessive and unjustified deadly force." He then cites several specific
  examples of Blackwater personnel firing at civilians, killing or
  "seriously" wounding them, and then failing to report the incidents to
  the State Department.
- He concludes, "Blackwater did nothing to stop
  this misconduct."
- Doe #1 also alleges that "all of these incidents of excessive force were
  initially videotaped and voice recorded," but that "Immediately after
  the day concluded, we would watch the video in a session called a 'hot
  wash.' Immediately after the hotwashing, the video was erased to prevent
  anyone other than Blackwater personnel seeing what had actually
  occurred." Blackwater, he says, "did not provide the video to the State
  Department."
- Doe #2 expands on the issue of unconventional weapons, alleging Prince
  "made available to his employees in Iraq various weapons not authorized
  by the United States contracting authorities, such as hand grenades and
  hand grenade launchers.
- Mr. Prince's employees repeatedly used this
  illegal weaponry in Iraq, unnecessarily killing scores of innocent
  Iraqis."
- Specifically, he alleges that Prince "obtained illegal
  ammunition from an American company called LeMas. This company sold
  ammunition designed to explode after penetrating within the human body.
  Mr. Prince's employees repeatedly used this illegal ammunition in Iraq
  to inflict maximum damage on Iraqis."
- Blackwater has gone through an intricate rebranding process in the
  twelve years it has been in business, changing its name and logo several
  times.
- Prince also has created more than a dozen affiliate companies,
  some of which are registered offshore and whose operations are shrouded
  in secrecy.
- According to Doe #2, "Prince created and operated this web
  of companies in order to obscure wrongdoing, fraud and other crimes."
- "For example, Mr. Prince transferred funds from one company (Blackwater)
  to another (Greystone) whenever necessary to avoid detection of his
  money laundering and tax evasion schemes."
- He added: "Mr. Prince
  contributed his personal wealth to fund the operations of the Prince
  companies whenever he deemed such funding necessary. Likewise, Mr.
  Prince took funds out of the Prince companies and placed the funds in
  his personal accounts at will."
- Briefed on the substance of these allegations by The Nation,
  Congressman Dennis Kucinich replied, "If these allegations are true,
  Blackwater has been a criminal enterprise defrauding taxpayers and
  murdering innocent civilians."
- Kucinich is on the House Committee on
  Oversight and Government Reform and has been investigating Prince and
  Blackwater since 2004.
- "Blackwater is a law unto itself, both internationally and domestically.
  The question is why they operated with impunity. In addition to
  Blackwater, we should be questioning their patrons in the previous
  administration who funded and employed this organization. Blackwater
  wouldn't exist without federal patronage; these allegations should be
  thoroughly investigated," Kucinich said.
- A hearing before Judge Ellis in the civil cases against Blackwater is
  scheduled for August 7.

the things that I wrote about were ridiculous. Why? Because they were
not reading the same documents I was reading.
At the 101 global meetings
I have covered around the world, these kinds. of ideas were considered
exciting and were being actively discussed, as they are now.

- Also
  in 1994, The Bretton Woods Commission which was convened by Paul Volcker,
  former Federal Reserve Chairman and James D. Wolfensohn who was the
  Director of the World Bank met.
- Their report confirmed the 1994 Human
  Development Report and called for “greater economic convergence
  among countries.”
- With regard to a world monetary system, the
  Commission stated,
  
  Any
  future international monetary system should focus on the major international
  currencies which dominate trade and global capital markets. For some
  time to come these will be the dollar, the yen and the Deutsch mark
  [or its successor European currency). The alternative to a new global
  system is to continue the present non-system of loose ad hoc cooperation,
  dominated by the G7 process (pages 4-5).
- Furthermore
  the Bretton Woods Commission said the IMF “should be given a central
  role to play in coordinating macroeconomic policies and in developing
  and implementing monetary reforms.”
- They said that the IMF should
  be given surveillance in order to secure a more stable exchange rate
  system and that the Special Drawing Rights are needed—but not
  now, and should be considered at some other time.”
- Interestingly
  enough the Bretton Woods Commission was supported by numerous foreign
  and American Banks which included, J.P. Morgan, Kidder Peabody International,
  Inc., Merrill Lynch, Morgan Stanley Group, Salomon Brothers, The Ford
  Foundation, The Carnegie Endowment for International Peace, The German
  Marshall Fund and S. G. Warburg Group. Some of these banks no longer
  exist and some even had trouble earlier in our current banking crisis.
- I
  was seeing the plan for a future world governmental structure.
- I used
  the 1994 Human Development Report as my blueprint for the future
  and what I should look for.
- Then
  in February, 2004, I interviewed U.S. Treasury Deputy Assistant Secretary
  for Public Affairs, Tony Fratto at the G7 Finance Ministers meeting
  in Boca Raton, Florida. Part of our discussion follows:
- Veon:
  Given the drop in economic, financial, and trade barriers and as America
  moves into a global economy what else needs to be done to complete this
  global economy?
- Fratto:
  There is still a lot more that needs to be done. There are many countries
  around the world with trade barriers affecting financial services, affecting
  capital flows, allowing for financial service firms to invest and be
  welcomed into their countries and we are going to see a lot more of
  that and it is part of the Free Trade Agreements and negotiations, regionally
  and at the Doha Round [WTO level].
- Treasury plays a major role in negotiating
  the investment chapters [of the WTO Agreement] and the chapters that
  concern financial flow and we will see more of that.
- Veon:
  The Bank for International Settlements set up the Financial Stability
  Forum-FSF—how important is that in today’s economy to manage
  a global system without borders?
- Fratto:
  It is very important. We participate in the FSF regularly and it is
  very important to help ensure that markets across the world are operating
  properly and that financial services firms are coping with regulation
  and changing landscape and financial services. So it is very, very important.
- Veon:
  Given the fact that the economic, trade, financial, political and information
  barriers between the nation-states have fallen, is there a deadline—2014
  or 2020 for the completion of the global financial architecture?
- Fratto:
  No one has put a specific date on it. From our perspective, we don’t
  want to be bound by deadlines, but we want to see progress—steady
  and every day on these issues. Things like Basel II, we are moving that
  forward. The liberalization of rules for capital flows—you will
  see more of that.
- Veon:
  Foreigners have been willing to hold U.S. debt because it is a reserve
  currency, is there any discussion of a shift to the dollar sharing the
  reserve currency with the euro?
- Fratto:
  I will not comment.
- Veon:
  If 65% of central bank foreign exchange reserves are in dollars, will
  you be discussing how much more they will be willing to hold of dollars?
- Fratto: I will let the ministers address those kinds of questions.
- As
  you can see, the U.S. Treasury was actively working to expand a global
  economic infrastructure.

- The things that I was hearing on the international
  level, along with the ideas of the 1994 Human Development Report,
  were common knowledge to everyone except the American people.
- Later
  on in November, I interviewed Paul Volcker and specifically asked him
  about what he saw for the future.
- He told me, “What the world
  needs is a global currency.” I asked if he meant “the Special
  Drawing Right.” He refused to answer.
- Then in 2007, I interviewed
  him again and asked about the Special Drawing Right. He told me that
  it had not been on his lips for years. His actions and words are not
  the same.
- As
  a result of the 2008 Credit Crisis which continues in 2009, Congress
  has been trying to understand the agenda behind the actions of the U.S.
  Treasury and the Federal Reserve.
- In an exchange between Congressman
  Ron Paul (R-TX) and Paul Volcker on February 24, 2009, Ron Paul specifically
  asked him about his opening statement to the House Banking Committee
  in which he talked about “strong coordination among national authorities,
  unifying accounting standards, liquidity requirements, and ‘internationally
  agreed to’ arrangements.”
- Congressman Paul wanted to know
  if Volcker was referring to “a super IMF or if we were going to
  revive the SDRs?
- What kinds of discussion are going on internationally
  right now to devise a standard and are you a participant in these international
  negotiations to come up with this new system?”
- Paul Volcker told
  him, “No, No. I don’t know of any coherent or regular discussion
  going on officially and there are very few going on unofficially in
  terms of construction of the monetary system.”
- As they bantered
  back and forth with Volcker refusing to give forthright answers, Volcker
  said, “I can’t tell you the answers—they are not apparent.
  Make no mistake. This is a unique moment in economic history where the
  world is going on the basis of fiat currencies.”
- It was apparent
  by his answers, his laughter at Ron Paul’s forthrightness, and
  his body language that he had no desire to be honest in his global involvement.
- In short, we have the global crisis which the 1994 Human Development
  Report said would probably need to happen in order to shift to
  a global system of government.
- It is also glaringly noticeable that
  the report was right on the money in terms of where the world needed
  to move to complete a global integration of countries.
- Without the continuous
  move to drop the barriers between nation-states that began with the
  birth of the International Monetary Fund and the World Bank in 1944
  and continued into the 1990s with the birth of the World Trade Organization
  in 1994, it would not be possible to have the global financial integration
  through common regulatory laws that the leaders of the G20 are calling
  for.
- Furthermore, a world central bank, the Special Drawing Rights,
  and an Economic Security Council would not be possible.
- However in a
  world where there are no longer any barriers between nation-states,
  total integration and a world government structure is possible.
- The
  newly empowered G20 is actively pursuing greater powers and responsibilities
  for the IMF.
- The IMF already has power over all countries, including
  the U.S., as it does country financial assessments.
- Furthermore, the
  Special Drawing Right was adopted by the Bank for International Settlements
  in 2004 when they switched “for bookkeeping entries” as
  I was told from the Swiss franc to the SDR.
- In 1999, when the Financial
  Stability Forum while set up, was never given much public attention,
  now it is at the center of the G20 discussions.
- Lastly, in conjunction
  with the G20 meetings, a special commission at the United Nations headed
  up by Dr. Joseph Stiglitz is calling for the G20 to become a fully recognized
  Economic Security Council on par with the Security Council.
- The
  bottom line is that the above comprises the moving of the ground beneath
  us.
- Everything we have experienced as a sovereign country is in the
  process of being changed.
- The enemy cannot have the advantage over you
  in battle if you know his agenda. Do you hear the snorting of the horses
  yet?

- With
  the nomination of Harold Hongju Koh, the Dean of Yale Law School, as the
  Legal Adviser for the State Department, President Barack Obama is putting
  a world government team in place under Secretary of State Hillary Clinton.
- The other key appointment was Anne-Marie Slaughter, the dean of Princeton
  University’s Woodrow Wilson School of Public and International Affairs,
  as Director of Policy Planning at State.
- Slaughter wrote the 2004 book,
  A New World Order, and believes in an international system dominated
  by the U.N. and other global institutions and networks.
- Some
  conservatives in the media have been pointing out that Koh has extremely
  radical views that seem to subordinate U.S. laws and the U.S. Constitution
  to so-called international law.
- Some say he even would allow the application
  of Islamic Shariah law in the U.S.
- But the conservative media focus on
  Koh’s controversial and disputed comments about Shariah miss the
  point.
- Based
  on his public statements, one has to conclude that Koh believes in a world
  government financed by global taxes.
- This is the huge issue that the media
  should bring to the fore. America’s future as a sovereign nation
  is at stake.
- Koh’s
  acknowledged mentor was Harvard Law Professor and international lawyer
  Louis B. Sohn, who was not only a key author of the U.N. Convention on
  the Law of the Sea (UNCLOS), now waiting for Senate ratification, but
  offered a detailed proposal to transform the United Nations into a world
  government in his book, World Peace Through World Law.
- The
  fancy academic titles and affiliations sound impressive. But even a casual
  reading of Sohn’s views would conclude that he was a dangerous crackpot.
- Sohn
  said that he wanted this world government to maintain hundreds of thousands
  of troops, military bases, and be armed with nuclear weapons.
- The purpose,
  he said, would be to disarm “each and every nation and to deter
  or suppress any attempted international violence.”
- This
  “world authority” would also require a “United Nations
  Revenue System,” drawing taxes from “each nation” of
  the world, he said.
- The
  term “world government” is too benign for what Sohn proposed.
  The term “global dictatorship” would be more appropriate.
- But this is the direction that Koh apparently would take us.
- Koh,
  who served as Assistant Secretary of State for Democracy, Human Rights
  and Labor in the Clinton Administration, referred to Sohn during an October
  24, 2006, George Washington University Law School tribute as “my
  grandfather in the law” because Koh, his sister, and his father
  had all studied under “his watchful eye.”

  essay
  based on his remarks, Koh explained that “In a dazzling range of
  areas—including arms control, the law of the sea, the law of state
  responsibility, the law of international organizations, international
  environmental law, and international dispute resolution—Louis helped
  draft global ‘constitutions’ that sought both to allocate
  institutional responsibilities and to declare workable rules of international
  law.”
- “Once I became an international
  law professor myself, Louis took me under his wing in a familial way,”
  Koh said.
- But
  the influence didn’t end there.
- “We would have lunch together, once at Grand Central Station,
  but more regularly at the annual meeting of the American Society of International
  Law.”

  continuing influence was seen in Koh’s selection of Charles J. Brown
  as his chief of staff from 1999-2001 in the Clinton Administration.
- Brown
  later became the president and CEO of the Citizens for Global Solutions
  (CGS), the new name of the pro-world government World Federalist Association
  (WFA).
- The name of the organization was changed in order to divert public
  attention away from its origins in the world government movement.
- CGS
  collaborated with the Open Society Institute of George Soros against John
  Bolton’s nomination as U.S. Ambassador to the U.N.
- The
  World Federalists are sometimes regarded as small and without much influence,
  but the fact is that prominent personalities such as Walter Cronkite,
  the former CBS Evening News anchorman, are world federalists.
- What’s
  more, President Clinton and then-First Lady Hillary Clinton endorsed the
  group’s activities during the time of the Clinton Administration.
- Koh’s
  nomination will be considered by the Senate
  Foreign Relations Committee, but it’s questionable at this point
  which members, if any, will raise any objections.
- The committee is headed
  by Senator John Kerry and its ranking “Republican,” Richard
  Lugar of Indiana, is a major backer of the United Nations who worked closely
  with Obama when he was also a member of the committee.
- Lugar is a strong
  supporter of various U.N. treaties, including the Convention on the Law
  of the Sea (UNCLOS).
- UNCLOS
  has always been seen by these people as a major step down the road to
  world government.
- The World Federalists declared that, by “establishing
  global governance” over the seabeds of the oceans and that by stipulating
  that mining of those areas beyond national jurisdiction “should
  require payment of royalties” to a United Nations body, UNCLOS has
  created “a funding resource that would be independent of voluntary
  contributions by the treaty member nations.”
- Hence, through UNCLOS,
  global taxes on the U.S. would come into effect.
- Interestingly,
  Sohn and identified Soviet spy Alger Hiss, a top State Department official
  at the time, were both major players in the conferences that resulted
  in the creation of the United Nations in 1945. There is no clear record
  of them working together, however.
- Ignoring
  Hiss, Koh gushed that Sohn was “quite literally present at the creation
  of the U.N.” and “became nothing less than an architect of
  the new world order.”
- Koh seems to view his role as helping to complete
  construction of this edifice.
- In order
  to understand the ominous future that Sohn and his disciple Koh have planned
  for us, one must review Sohn’s book, World Peace Through World
  Law, which was first published in 1958 and co-authored with Grenville
  Clark of the World Federalists.
- It is considered a classic by World Federalists
  and is listed in the “timeline” of the history of world federalism.
- Sohn’s writings are also featured in the book, Uniting the Peoples
  and the Nations: Readings in World Federalism.
- In the
  preface to the book, Robert Woito writes that UNCLOS is an example of
  “how the broad principles outlined in World Peace Through World
  Law can be applied to a specific problem.”
- Sohn, he noted “played
  a significant role in the Law of the Sea conference.”
- As noted,
  Koh has declared that Sohn’s work on UNCLOS was one of several areas
  in which he helped draft global “constitutions” to manage
  international affairs.
- Koh called this the “transnational legal
  process” and noted that Sohn’s book, World Peace Through
  World Law, was part of a “stunningly ambitious global project.”
  Koh said that “unfortunately,” Sohn’s blueprint did
  not come to pass.
- Unfortunately?
  This is the tip-off that Koh wants to see this dangerous New World Order
  implemented.
- He is declaring, for all to see, that he favors Sohn’s
  concept of world government.
- As far
  as UNCLOS is concerned, Sohn’s fingerprints were all over it.
- The
  Washington Post acknowledged that Sohn, who died in 2006, “shaped
  the Law of the Sea Convention and the Law of the Sea Tribunal.”
  He was, according to a tribute in his honor, “instrumental”
  in shaping the U.N. Convention on the Law of the Sea.
- In World Peace Through World Law, one of his underlying principles
  was the need for “equitable management of mankind’s common
  resources—especially outer space and the oceans…”
- Sohn
  proposed a “United Nations Ocean Authority” that would eventually
  be expressed in UNCLOS as the International Seabed Authority, a vehicle
  to control vast areas of the oceans beyond the authority of sovereign
  states.
- The
  recipient of awards and medals from the American Society of International
  Law and the World Federalists of Canada, Sohn declared in World Peace
  Through World Law that “the race to exploit the oceans and
  the seabed can lead to new disastrous conflicts unless this ‘common
  heritage of mankind’ is put under United Nations management and
  supervision.”
- This
  revolutionary, even Marxist, concept, did in fact become part of UNCLOS.
  And it was one reason why President Ronald Reagan rejected it.

  Sohn’s role in crafting UNCLOS has not been the subject of examination
  by the Senate, his colleagues in the academic and legal communities are
  fully aware of what he proposed and what he did.
- “Louis contributed
  significantly to the formulation of a text for the U.N. Convention on
  the Law of the Sea,” noted Detlev F. Vagts, Bemis Professor of International
  Law Emeritus at Harvard Law School.
- Thomas
  M. Franck, the Murray and Ida Becker Professor Emeritus at the New York
  University School of Law, gave Sohn specific credit for Annex 7 of UNCLOS,
  “which established a model for the mandatory peaceful resolution
  of disputes.”
- Franck said that “many” representatives
  of “landlocked and disadvantaged states” during negotiations
  on UNCLOS “were former students [of Sohn] like me.”
- Daniel
  Barstow Magraw, president of the Center for International Environmental
  Law, identified Sohn as “one of four chief negotiators on the U.S.
  delegation to the Third United Nations Conference on the Law of the Sea
  (UNCLOS III), which eventually produced the 1982 Law of the Sea Convention.”
- He quoted Elliot Richardson, the head of the U.S. delegation and “a
  student in the first class Louis taught at Harvard Law School,”
  as saying that Sohn was “an indispensable resource” for the
  U.S. delegation and the conference as a whole.

  conceded, however, that Sohn’s book, World Peace Through World
  Law, envisioned “an unusually strong world government…”
- As the
  Senate prepares to consider UNCLOS and other treaties, it is time to examine
  the influence of Sohn and other like-minded extremists, radicals, and
  revolutionaries.

- The Obama administration's decision to join the planning of the U.N.'s Durban II "anti-racism" conference has just taken a new twist: cover-up.
- On Friday, State Department officials and a member of the American Durban II delegation claimed the United States had worked actively to oppose efforts to brand Israel as racist in the committee drafting a Durban II declaration. The trouble is that they didn't.
- The Feb. 20 State Department press release says the U.S. delegation in Geneva "outline[d] our concerns with the current outcome document" and in particular "our strong reservations about the direction of the conference, as the draft document singles out Israel for criticism."
- One member of the delegation told The Washington Post: "The administration is pushing back against efforts to brand Israel as racist in this conference."
- In fact, tucked away in a Geneva hall with few observers, the U.S. had done just the opposite.
- The U.S. delegates had made no objection to a new proposal to nail Israel in an anti-racism manifesto that makes no other country-specific claims.
- Getting involved in activities intended to implement the 2001 Durban Declaration--after seven and a half years of refusing to lend the anti-Israel agenda any credibility--was controversial to be sure.
- But late on Saturday Feb. 14, the State Department slithered out a press release justifying the move.
- It claimed that "the intent of our participation is to work to try to change the direction in which the Review Conference is heading."
- Following what was clearly a planned public relations exercise, Washington Post columnist Colum Lynch championed the U.S. bravado in an article based on the story orchestrated by the American delegates.
- In his Feb. 20 article entitled: "U.S. Holds Firm on Reparations, Israel in U.N. Racism Talks," he fawned: "The Obama administration on Thursday concluded its first round of politically charged U.N. negotiations on racism, pressing foreign governments ... to desist from singling out Israel for criticism in a draft declaration to be presented at a U.N. conference in April."
- The reality, however, was nothing of the sort. Instead, Obama's Durban II team slipped easily into the U.N.'s anti-Israel and anti-Jewish environs, taking the approach that "fitting in" was best accomplished by staying silent.
- On Tuesday, the Palestinian delegation proposed inserting a new paragraph under the heading "Identification of further concrete measures and initiatives ... for combating and eliminating all manifestations of racism, racial discrimination, xenophobia and related intolerance..." with the subtitle "General provisions on victims ... of discrimination."
- The paragraph includes: "Calls for ... the international protection of the Palestinian people throughout the occupied Palestinian territory."
- In other words, it claims that the Palestinian people are victims of Israeli racism and demands that all U.N. states provide protection from the affronts of the racist Jewish state.
- Furthermore, the new Palestinian provision "Calls for ... implementation of international legal obligations, including the advisory opinion of the International Court of Justice on the wall..." This is a dramatic attempt to change an "advisory opinion" into a "legal obligation"--a status which attaches to no advisory opinion.
- The ICJ decision, which advises that the Israeli security fence is illegal, has always been rejected by the United States--hitherto. And with good reason.
- The Egyptian judge had voiced his opinion on the result before the case was even heard, in his capacity as a leading Egyptian diplomat.
- The terms of reference from the General Assembly who asked for the decision, and the documents they laid before the Court, predetermined the outcome.
- And as the strong dissent by the American judge and Holocaust survivor Tom Buergenthal pointed out, the Court came to its preposterous conclusion that "the right of legitimate or inherent self-defense is not applicable in the present case" without considering "the deadly terrorist attacks to which Israel is being subjected."
- But when the Palestinian delegation laid their new proposal before the drafting committee, what did Obama's team do? Nothing, absolutely nothing. They made no objection at all.
- It is impossible to argue that their silence was unintended. Over the course of the week's negotiations the American delegation had objected to a number of specific proposals.
- They had no trouble declaring "we share reservations on this paragraph," in the context of a demand to criminalize profiling.
- They "called for the deletion" of provisions undermining free speech like the suggestion to "take firm action against negative stereotyping of religions and defamation of religious personalities, holy books, scriptures and symbols."
- Their silence when it came to Israel was, therefore, deafening.
- It also had the very concrete result of not placing the Palestinian paragraph in dispute, and the diplomatic rule of thumb is that paragraphs that have not been flagged as controversial cannot be reopened for discussion, as negotiations finalize an end product.
- The Obama team was not only silent on the new "Israel is racist" language, it also said nothing when faced with Holocaust denial.
- Negotiators from the European Union suggested on Wednesday a new provision to "condemn without reservation any denial of the Holocaust and urges all states to reject denial of the Holocaust as an historical event, either in full, or in part, or any activities to this end."
- Iran--whose president is a Holocaust-denier--immediately objected and insisted that the proposal be "bracketed" or put in dispute.
- The move blocked the adoption of the proposal and ensured another battle over the reality of the Holocaust in April--at these supposedly "anti-racism" meetings.
- After Iran objected, the chair looked around the room, expecting a response. He said: "Is there any delegation wishing to comment on this new proposal by the European Union? It doesn't seem the case. We move on." U.S. delegates said nothing, even after the prompt.
- In marked contrast, after the E.U. objected to a provision calling for limits on free speech, the American delegation had no trouble piping up immediately: "I want to echo the comments from the E.U. This ... call for restrictions is something that my government is not able to accept."
- Again, the American silence must have been deliberate.
- Evidently, a U.S. team bent on legitimizing Durban II believed it would be counter-productive to object vigorously to sections most likely to be noticed by Americans skeptical about participation in the conference.
- They must have figured that no objection would mean no controversy, which in turn would mean there would be no cause for complaint from U.S. observers. That's one way to buy favors on the international stage, but it sure doesn't forward a stated intention of changing the Conference direction.
- Nor does it promote the ultimate need to change the anti-Semitic and anti-democratic direction of global human rights policy.
- The week's events also revealed that European negotiators have adopted the same strategy at Durban II that they did at Durban I. After the United States and Israel walked out of Durban I on Sept. 4, 2001, it was the European Union that cut the deal trading off a mention of the Holocaust and anti-Semitism for a reference to Palestinians victims of Israeli racism.
- Likewise, this week the European Union said nothing in response to the Palestinian proposal but pushed the Holocaust reference instead. No matter that discrimination against the Jewish state, and against Jews for supporting the Jewish state, is the major form of anti-Semitism today.
- The manipulation of Holocaust remembrance--knowing that Israel is the bulwark of the Jewish people against "never again"--is as cynical as it gets.
- European Union delegates confirmed that their silence on the Palestinian proposal was deliberate, commenting off-camera that the references to Israeli racism had already been made in the Durban I Declaration, and the purpose of Durban II is to implement Durban I.
- State department officials and U.S. delegates to Durban II's planning committee insist that their minds have not been made up.
- Friday's State department press release said "the United States has not made a decision about participating in the Durban Review Conference or about whether to engage in future preparations for the Conference, but the work done this week will be important information for taking these decisions."
- Similarly, The Washington Post reports, quoting an American delegate: "This is a fact-finding mission; it's just a first step ... Negotiations will probably resume in March or early April."
- The strategy is painfully obvious--spin out the time for considering whether or not to attend the April 20 conference until the train has left the station and jumping off would cause greater injury to multilateral relations than just taking a seat.
- The delay tactics are indefensible. The U.S. administration attended four full days of negotiation.
- During that time they witnessed the following: the failure to adopt a proposal to act against Holocaust denial, a new proposal to single out Israel, which will now be included in the draft without brackets, broad objections to anything having to do with sexual orientation, vigorous refusal by many states to back down on references to "Islamophobia" (the general allegation of a racist Western plot to discriminate against all Muslims), and numerous attacks on free speech.
- This "dialogue" is not promoting rights and freedoms. It is legitimizing a forum for disputing the essence of democracy, handing Holocaust deniers a global platform and manufacturing the means to demonize Israel in the interests of those states bent on the Jewish state's destruction.
- But you can be sure that the State Department report now on Obama's desk reads "can't tell yet, don't know, maybe, too early to tell." Why?
- If the Obama administration does not immediately announce that its foray into the morass of Durban II has led it to decide this is no place for genuine believers in human rights and freedoms, there is only one conclusion possible. His foreign policy of engagement amounts to a new willingness to sacrifice Israel and an indeterminate number of American values for the sake of a warm welcome from the enemies of freedom.

- The government of Iraq is moving forward with plans to protect the archaeological remains of the ancient City of Babylon, in preparation for building a modern city of Babylon.
- The project, originally started by the late Saddam Hussein, is aimed eventually at attracting scores of "cultural tourists" from all over the world to see the glories of Mesopotamia's most famous city.
- What's more, the Obama Administration is contributing $700,000 towards "The Future of Babylon Project," through the State Department's budget.
- "Officials hope Babylon can be revived and
- made ready for a rich future of tourism, with help from experts at the World Monuments Fund (WMF) and the U.S. embassy," reports the Reuters news agency.
- "'The Future of Babylon' project launched last month seeks to 'map the current conditions of Babylon and develop a master plan for its conservation, study and tourism,' the WMF says.
- 'We don't know how long it will take to reopen to tourists,' said Mariam Omran Musa, head of a government inspection team based at the site. 'It depends on funds.
- I hope that Babylon can be reborn in a better image.'"
- In my non-fiction book, Epicenter 2.0, I wrote about the Bible prophecies in Isaiah, Jeremiah, Ezekiel, and Revelation that indicate the ancient city of Babylon in Iraq will, in fact, be rebuilt in the "last days" of history and become the wealthiest and most powerful city on the face of the planet.
- I also cited my interview with Iraqi Finance Minister Ali Abdul Ameer Allawi who told me in 2006 at the peak of the insurgency,
  "Cultural, religious, archaeological, and biblical tourism is a big opportunity for Iraq. I think rebuilding Babylon is a wonderful idea, as long as it is not done at the expense of the antiquities themselves."

  most agreeing only that it was karma which overtook these pre-Flood peoples.
  An alternate story is that the "ascended masters" themselves sank Atlantis,
  considering it a failed experiment due to human unfaithfulness to The Plan.
  Still another teaching is that they lost a war with the "Lemurians", survivors
  of an older race (Bailey identifies
  that race with today's Jews: _Externalisation_, p.77)
- However Bailey (or
  more accurately, her guide the "Tibetan Master"), unwilling to attribute
  failure to the Hierarchy, says elsewhere
  that the Atlantean war was caused by the Hierarchy's decision to lead humanity
  into union of the opposites: spirit/matter, good/evil, light/dark, right/wrong.

- The only explanation
  universally shunned by NAers is that the disaster was judgment on a corrupt
  humanity, dealt out by a transcendent Judge as stated in the Jewish tradition.
- (2) There is no explanation for how the law of human
  evolution was defied - not once but twice - with the race of Jews managing
  to outlive both the destruction that wiped out Atlantis (the "superior
  race") and the preceding cataclysm in which Atlantis was to replace their
  "dying race".

  no explanation for why the Jews did not die out when their Aries Age ended
  and the new Piscean (Christian) Age commenced 2000 years ago, as the law
  of human evolution says must happen.

- This is according to classified US cables which I obtained in 1999 and
  reported in The Nation magazine.

  about what Blair had done, he was told to talk to Wiranto again. He again
  spoke to Wiranto, on the phone, and again reassured him, offered him
  new US military aid.
- Blair even offered Wiranto aid for the specific unit,
  the Brimob, the paramilitary police who had gone into that church as they
  chopped up the refugees and chopped up the clergy who were hiding there.
- General Wiranto naturally took this as reassurance. He escalated the attacks.
- Wiranto was later indicted for crimes against humanity. Blair has not
  been held to account. And now, they say Obama wants to make him Director

- JERUSALEM – A columnist for a Syrian government newspaper has lauded Sen. Barack Obama and his running mate, Sen. Joe Biden, explaining the two will "not deceive the [American] people regarding the danger of terrorism [and the need] to fight it."
- Nadia Damiati, a columnist for the Syrian government daily Al-Thawra, wrote Obama's and Biden's campaign slogan of "change and experience" indicated that "the Americans aspire for their country to take a moral stance, be an honest broker, act in accordance with the U.S. Constitution, not ignite wars, not spill the blood of innocents in the world, and not deceive the [American] people regarding the danger of terrorism [and the need] to fight it."
- The newspaper entry was translated into English by the Middle East Media Research Institute, or MEMRI.
- Obama's positive coverage in Syria follows some Syrian-related controversy for the presidential candidate after it was revealed one of his key foreign policy advisers traveled to Damascus where he reportedly urged Syrian officials to fast-track negotiations with Israel.
- Both Israel and Syria announced in May they were holding indirect talks aimed in part at an Israeli evacuation of most of the Golan Heights, which looks down on Israeli population centers and twice was used by Damascus to mount ground invasions of the Jewish state.
- The talks have been progressing at a very slow pace, with Syrian President Bashar Assad in Russia last week discussing military cooperation between Damascus and Moscow.
- But Daniel Kurtzer, a top adviser to Obama on Israeli-Palestinian affairs who visited Syria last month, reportedly has offered Syrian Foreign Minister Walid al-Moallem some advice.
- "I urged him to move ahead in the Israel-Syria negotiations as much as possible so that whoever is the next president would not start from too far down the track," Kurtzer disclosed in an interview with the New York Sun.
- "I did not say anything about Obama or McCain. I said whoever is the next president is not going to want to inherit a process that isn't going anywhere," Kurtzer said
- He stressed he was not in Damascus as part of Obama's campaign but instead visiting as a private expert attending an international lawyers conference.
- The event is co-sponsored by British organizations and arranged by the British Syrian Society, chaired by Dr. Fawaz Akhras, the father of the wife of Syrian President Assad.
- The conference was aimed at helping Syria develop legal programs and expand international contacts for the country's lawyers.
- Kurtzer is a high-profile Obama adviser on Mideast affairs identified by Israeli diplomatic sources as likely to become the Illinois senator's envoy to the Israeli-Palestinian issue if he wins the presidency.
- Kurtzer last month joined Obama in his visit to Israel.
- It is likely Syrian officials associated Kurtzer with Obama's campaign in their talks with him.
- Kurtzer said he informed the Obama campaign of his trip to Damascus.
- The State Department considers Syria a state sponsor of terror. Damascus openly hosts the leaders of the Palestinian Hamas and Islamic Jihad terror groups and is accused of providing weapons and financing to the Iranian-backed Lebanese Hezbollah terror group.
- The McCain campaign immediately seized on Kurtzer's trip to Syria.
- McCain spokesman Michael Goldfarb stated, "If one of Senator Obama's advisers has been to Damascus, we just wonder how many have been to Tehran."
- McCain's headquarters even held a public phone conference to discuss Kurtzer's Syria trip.
- Kurtzer long has been identified by Israeli leaders speaking on the record as one of Israel's greatest foes in Washington, and his appointment as a primary Mideast adviser to Obama raised some eyebrows in the pro-Israel Jewish community.
- "We oppose the appointment of Kurtzer because of his long, documented record of hostility to and severe pressure upon Israel," said Zionist Organization of America National Chairman Morton Klein.
- Kurtzer has been blasted by mainstream Jewish organizations, including the Conference of Presidents of Major American Jewish Organizations.
- He has angered Israeli leaders many times for pushing Israel into what they described as extreme concessions to the Palestinians.
- "With Jews like Kurtzer, it is impossible to build a healthy relationship between Israel and the United States," Benjamin Nentanyahu was quoted saying in 2001 by Israel's Haaretz newspaper.

- He noted that Defense Secretary Robert M. Gates has described the State Department and the U.S. Agency for International Development as "chronically undermanned and underfunded for too long."
- As the hearing showed, two programs that began in 2006 provided through the Pentagon the kinds of military and development funds to partner countries in the fight against terrorism -- support that is traditionally directed by the State Department.
- Section 1206 programs gave the Pentagon the authority to spend $200 million to train and equip foreign military forces to carry out counterterrorism operations in their own countries or give support elsewhere -- say, Iraq -- in association with U.S. forces.
- This change was needed because the traditional approach through State was "too slow and cumbersome," according to a May 2008 report by the Congressional Research Service (CRS).
- Section 1207, also initiated in 2006, gave the Pentagon the authority to transfer as much as $100 million in equipment, services or training to the State Department, which used the money for "reconstruction, stabilization or security activities in foreign countries," according to another May 2008 CRS report.
- Section 1207 programs were originated by country teams and needed approval from Defense and State leaders before they could be carried out.
- In testimony Thursday, Deputy Secretary of State John D. Negroponte called this a "dual-key" authority to ensure that Pentagon security needs met State Department foreign policy objectives.
- Undersecretary of Defense Eric S. Edelman, who appeared at the hearing, said these programs were born of "a fundamental mismatch of authorities, resources and capabilities."

- In its latest request, for fiscal 2009, the Pentagon sought $750 million in Section 1206 funds and $200 million in Section 1207.

WASHINGTON (AFP) — The Pentagon took a hands off approach to outbreak of hostilities between Russia and Georgia Friday, keeping tabs on US military trainers there and dusting off contingency plans should Americans need to be evacuated, Pentagon officials said.

- However, there were no plans to redeploy the estimated 130 US troops and civilian contractors who are stationed in the area around Tblisi, Pentagon spokesman Bryan Whitman said. He said all have been accounted for.
- "They are not involved in any way in this conflict between the Russian military and the Georgian military," said Lieutenant Colonel John Dorrian, a spokesman for the US European Command.
- The US military has had a longstanding program to train Georgian troops for deployments in Iraq, where there are currently about 2,000 troops, making Georgia the third largest troop contributor to the US-led coalition.
- The Georgian government said Friday it wants to bring home 1,000 troops from Iraq, and a US military official said the Pentagon has been asked for help in flying them home.

- "What they do in a situation like this is contact the embassy, contact our troops there, assess the situation, and begin to receive any information or request for support from the embassy, or any reports about US citizens being in danger."
- "At this point we are early in the hostilities. The situation is sort of dynamic at this point," he said.
- Asked about planning for a possible non combatant evacuation, Dorrian said, "We do have robust plans in place to support needs like that if they are required."
- Pentagon officials said such plans would be reviewed as a precaution in light of the situation although no request has been made by the State Department to evacuate civilians.
- "Normally plans like this are dusted off and given a fresh look," said a defense official, who asked not to be identified.
  "There is always contingency planning that takes place over a continuous period. When a moment of crisis seems to appear, they are looked at with fresh eyes at that time," the official said.
- The United States, European Union and NATO have led international calls for an immediate end to violence in South Ossetia amid fears of all-out war between Russia and Georgia.
