So the EPA’s proposed ruling on so-called “Greenhouse Gases” can be opposed extensively with litigation, to the point that the ruling might not yet be in force when Obama demits office.

In the second place, the EPA is funded by Congress. So, if the Agency is being used to bypass or neuter Congress, why should legislators not play hardball and retaliate by cutting off its funding?

When the EPA published its “Endangerment Finding” on greenhouse gases and proposed rule, back in April, almost every paragraph of the text (Federal Register, April 24, 2009, pp 18886-18910) cited as authority the IPCC’s 2007 Report, which the Agency acknowledges it “relies on most heavily”.

As a Brit, I am unbelievably jealous of the American Constitution. It is a work of art, giving true democracy and power to the people. Those who drafted it knew all too well how governments sour, and how totalitarianism devours. I just hope the American people will stand firm to defend it, while there is time left.

My growing distrust of climate scientists is bad enough, but the thing that worries me the most is the proposed solution to environmental issues, which is to destroy national sovereignty and further enslave us all. It is a violation of inalienable rights to initiate force against anyone. President Obama has dispatched a delegation this week to The Hague to explore issues involving the United States' possible participation in the International Criminal Court,

an organization critics charge could be used to prosecute Americans under international legal standards for actions that are not crimes in the U.S.

Andy Laney of the U.S. State Department confirmed the delegation is comprised of members of the State Department as well as the Defense Department.

He said they were dispatched on a weeklong trip because of U.S. concerns over how "aggression" is defined internationally.

"There is an interagency party, half from the State Department, half from the Defense Department, there to engage other delegations on matters of U.S. interest and specifically over our concerns on the definition of the crime of aggression," he said.

Critics, however, warn that they believe former U.S. war crimes prosecutor Ambassador Stephen Rapp is on a trip that involves more than just the definition of a word.

"The Obama administration would like the U.S. to be a party to the court," said Brett Schaefer, an international regulatory expert with the Heritage Foundation.

"Israel took action in Gaza earlier this year to attack Hamas and knock out the Hamas rocket launchers in the Gaza Strip," he said. "Israel took enormous cautionary measures to prevent civilian casualties.

Even though Israel and the Palestinian Authority are not signatory members of the ICC, the ICC is still investigating the Israeli military to see if they can prosecute members of the Israeli Army for war crimes."

Mathew Staver, lead attorney for Liberty Counsel and dean of Liberty University Law School, said U.S. membership in the ICC would be a mistake.

"This administration is globalist and transnationalist and wants to bring this country into the global system.

The U.S. stands to have its citizens being prosecuted by the international court in The Hague and have its citizens come under the world court's jurisdiction," he said.

Schaefer confirmed Staver's fears.

"Supposing the U.S. engages in a military action and that action results in civilian casualties. We do an investigation of the matter and find no guilty party. If we are a member of the court, if we are a party to the Rome Statute, the ICC at that point has the opportunity to second-guess us," he said.

"They may be able to use evidence and they may be able to pursue routes of trial that would not be portable in the U.S. because of the different standards established in the U.S. legal system and the rules set forth in the Rome Statute."

SAN JOSE, Calif. -- When California wildfires ruined their jewelry business, Tony Becker and his wife fell months behind on their mortgage payments and experienced firsthand the perils of subprime mortgages.

The couple wound up in a desperate, six-year fight to keep their modest, 1,500-square-foot San Jose home, a struggle that pushed them into bankruptcy.
-
The lender with whom they sparred, however, wasn't the one that had written their loans. It was an obscure subsidiary of Wall Street colossus Goldman Sachs Group .
-
Goldman spent years buying hundreds of thousands of subprime mortgages, many of them from some of the more unsavory lenders in the business, and packaging them into high-yield bonds.
-
Now that the bottom has fallen out of that market, Goldman finds itself in a different role: as the big banker that takes homes away from folks such as the Beckers.
-
The couple alleges that Goldman declined for three years to confirm their suspicions that it had bought their mortgages from a subprime lender,
-
even after they wrote to Goldman's then-Chief Executive Henry Paulson -- later U.S. Treasury secretary -- in 2003.
-
Unable to identify a lender, the couple could neither capitalize on a mortgage hardship provision that would allow them to defer some payments, nor on a state law enabling them to offset their debt against separate, investment-related claims against Goldman.

In July, the Beckers won a David-and-Goliath struggle when Goldman subsidiary MTGLQ Investors dropped its bid to seize their house.
-
By then, the college-educated couple had been reduced to shopping for canned goods at flea markets and selling used ceramic glass.
-
Theirs is an infrequent happy ending among the hundreds of cases in which subsidiaries of Goldman, better known for sending top officers such as Paulson to serve in top Washington posts, have sought to contain bondholder losses by foreclosing on properties and evicting delinquent borrowers.

Goldman spokesman Michael DuVally declined to comment on individual cases or on the firm's new role in bankruptcy courts.

Joining other Wall Street firms that bought millions of subprime mortgages, Goldman companies have gone to courts from California to Florida seeking approval to foreclose on the homes of middle- and lower-income Americans who couldn't keep up with their loans' soaring monthly payments.

Some borrowers were speculators or homebuyers who exaggerated their incomes on loan applications, thinking they'd always have an escape hatch because housing prices would keep rising.

Others, however, were victims of fast-talking mortgage brokers who didn't explain that the loans' interest rates could rise to as high as 15 percent. Many borrowers who defaulted on their mortgages may never qualify for a home loan again.

In court encounters, Goldman and other Wall Street firms have faced the impact of their own wheeling and dealing.

Many of the families being put on the street never would've gotten their big mortgages if investment banks hadn't provided a seemingly insatiable secondary market for millions of loans to marginally qualified buyers.

Subprime borrowers were supposed to provide a safe income stream for investors who bought mostly high-grade, triple-A-rated bonds from Goldman and bigger subprime players, such as now-defunct Lehman Brothers and Merrill Lynch .

Now, millions of these borrowers have defaulted on mortgage payments, contributing to a historic slump in home prices and depressing the bonds' value. Half the homes in some California neighborhoods have been subject to foreclosures or short sales, in which a home is sold for less than the mortgage balance, and either the seller or the lender takes a loss.

Earlier this year in Los Angeles , the Wall Street giant took possession of the home of Gladys Aguirre , a housecleaner who's married to a construction worker. Together, the couple listed monthly earnings of $7,480 , including $3,480 from a job she'd held for two months.

Aguirre originally took a $444,000 subprime mortgage on Sept. 1, 2005 , from Argent Mortgage Co. , a subsidiary of big subprime lender Ameriquest Mortgage Co. , which shut down in 2007. The adjustable interest rate sent her monthly payments zooming to $3,800 from $2,479 , and Aguirre couldn't keep pace on that loan or a $119,000 second mortgage. She filed for bankruptcy protection.

Aguirre's Los Angeles lawyer, Eber Bayona , declined to discuss her case, but said that subprime loans amounted to "setting up the person for failure" because interest rate adjustments hit borrowers with "shock payments."

For example, he said, loan agents promised applicants that they could buy a $600,000 house for payments of $1,200 a month, and the buyers "never read the fine print . . . (and) didn't know their interest would increase and that eventually they would lose their house and their money."

In San Fernando, Calif. , Dina Alfero-Pacheo qualified for two mortgages totaling nearly $500,000 , with monthly payments starting at $2,004 . By 2007, the payments had grown to $3,761 . In a bankruptcy filing early this year, Alfero-Pacheo said she was a bartender earning $3,800 a month.

Goldman bought her first mortgage from Argent and recently got title to the house, which had sunk in value to $280,000 from more than $500,000 .

In Orlando, Fla. , Adela Mendez seems to be someone who would've known the risks when she took a $164,000 mortgage from Argent on her home in 2005 and a $75,000 second mortgage a year later. In a bankruptcy filing this year, she listed her occupation as a loan specialist for Washington Mutual , a leading subprime lender that collapsed last year.

Not only did Mendez fall 11 months behind on her mortgage payments, but her home's value also plummeted to $100,000 .

The Beckers charged that in their case, Goldman engaged in years of obfuscation and resistance.

"In bankruptcy court, they tried to portray us as incompetent or deadbeats,'' said Celia Fabos-Becker , blinking back tears as she sat with her husband in their living room, with boxes of mortgage-related documents surrounding them.

The couple thought they'd made a safe bet in 2000 when they opened a retail jewelry business in two San Diego County areas populated mainly by military personnel.

The wars in Afghanistan and Iraq , however, brought big military call-ups, sapping their market.

After a wildfire ravaged much of the area in 2002, the Beckers refinanced their house to generate some $70,000 in cash to prop up their two stores.

They wound up with an adjustable-rate, subprime loan from WMC Mortgage Corp. , an arm of General Electric's GE Money unit, and a 10.75 percent second mortgage with the same lender.

A second wildfire in 2003 all but killed their business and left the couple reeling financially as interest-rate adjustments pushed the mortgage payments higher.

"We'd gotten to the point where I was cutting my own hair. I was cutting his on occasion," Fabos-Becker said.
"And trolling the Goodwills," Tony Becker said. -
Tony Becker , an engineer, took short-term contract jobs amid the technology bust. Celia Fabos-Becker , meanwhile, found a provision in the mortgages that allowed the borrower to push payments to the end of the loan term in the event of a disaster such as the two fires.

To stall foreclosure, the Beckers wound up negotiating "forbearance agreements" with Ocwen Loan Servicing, a Florida company, that required the couple to pay several thousand dollars under the threat that their house would be auctioned off in a week or a month, Fabos-Becker said. Their monthly payments rose to nearly $3,300 from $2,650 .

The couple already had taken Goldman and Morgan Stanley , another Wall Street firm, to arbitration over their $325,000 in stock market losses, accusing the investment banks of misleading investors about public offerings.

On the same day in June 2006 , Goldman sued to end the arbitration, and Ocwen filed papers seeking to foreclose on the Beckers' home.

In desperation, the couple filed for bankruptcy protection. With no money to hire an attorney, they acted as their own lawyers.

As the months dragged on, Fabos-Becker finally found a filing with the Securities and Exchange Commission confirming that Goldman had bought the mortgages.

Then, when a lawyer for MTGLQ showed up at a June 2007 court hearing on the stock battle, U.S. District Judge William Alsup of the Northern District of California demanded to know the firm's relationship to Goldman, telling the attorney that he hates "spin."
The lawyer acknowledged that MTGLQ was a Goldman affiliate. -
That was an understatement. MTGLQ, a limited partnership, is a wholly owned subsidiary of Goldman that's housed at the company's headquarters at 85 Broad Street in New York , public records show.

In July, after U.S. Bankruptcy Judge Roger Efremsky of the Northern District of California threatened to impose "significant sanctions" if the firm failed to complete a promised settlement with the Beckers, Goldman dropped its claims for $626,000 , far more than the couple's original $356,000 in mortgages and $70,000 in missed payments. The firm gave the Beckers a new, 30-year mortgage at 5 percent interest.

That lowered their monthly payment to $1,900 , less than half the maximum $4,000 a month their subprime loans could've demanded.

Fabos-Becker, 60, said that the trauma has left her hair "a lot grayer." Much of the stress would have been alleviated, she said, if a law required lenders to identify themselves, especially to borrowers facing hardships.

"I take solace," Tony Becker said, "in knowing that I was up against the worst possible opponent -- the biggest, strongest investment bank in the world."

The government, ever anxious not to take responsibility, will single out the petroleum factories and oil companies for gauging the people.

They will make demands for them to cut prices, which of course means working for a loss.

When plants start to close down or move overseas, they will be called racketeers and saboteurs.

Their facilities will be nationalized so that the government can show them how to do things properly.

Shortages will follow as will show trials and that's as long as the USD holds up and foreign nations are still willing to sell oil and gasoline for other than gold, silver and other hard resources.

When food goes up, and it surely will, as the diesel the farmer uses goes up as well as his fertilizers, the government will scream that the farmers are hording, thus undermining the efforts of the enlightened.

There will be confiscations of all feed crops while the farmers will get production quotas to meet or have their land nationalized again.

Do not believe me? Look at the people running your governments and ask yourself: would they rather take some one's land or admit that they screwed up and ruined everything?

After a point, only the corporate farms will remain, food by oligarch, just a like the factory farms. There will be plenty of dissidents to work them.

This will of course spread from industry to industry and within a rather short order, you will be living the new fractional dream, that is a fraction of what you have now.

But on the bright side, for once, your children, working for government/oligarch run joint ventures, will be able to compete adequately with the Chinese, to feed the demands of Europe and Latin America.

(CNSNews.com) – House Majority Leader Steny Hoyer (D-Md.) said that the individual health insurance mandates included in every health reform bill, which require Americans to have insurance, were “like paying taxes.”

He added that Congress has “broad authority” to force Americans to purchase other things as well, so long as it was trying to promote “the general welfare.”

The Congressional Budget Office, however, has stated in the past that a mandate forcing Americans to buy health insurance would be an “unprecedented form of federal action,” and that the “government has never required people to buy any good or service as a condition of lawful residence in the United States.”

Hoyer, speaking to reporters at his weekly press briefing on Tuesday, was asked by CNSNews.com where in the Constitution was Congress granted the power to mandate that a person must by a health insurance policy.

Hoyer said that, in providing for the general welfare, Congress had “broad authority.”

“Well, in promoting the general welfare the Constitution obviously gives broad authority to Congress to effect that end,” Hoyer said. “The end that we’re trying to effect is to make health care affordable, so I think clearly this is within our constitutional responsibility.”

Hoyer compared a health insurance mandate to the government’s power to levy taxes, saying “we mandate other things as well, like paying taxes.”

The section of the Constitution Hoyer was referring to, Article I, Section 8, outlines the powers of Congress, including raising taxes, but not the purchasing any type of product or service.

The opening paragraph of Section 8 grants Congress the power to raise taxes to, among other things, “provide for the … general welfare of the United States.”

Section 8 partly reads: “The Congress shall have Power to lay and collect Taxes, Duties, Imposts and Excises, to pay the Debts and provide for the common Defence and general Welfare of the United States; but all Duties, Imposts and Excises shall be uniform throughout the United States.”

The Constitution then details the specific powers of Congress, including raising an Army and Navy, regulating commerce between states, and to “make all laws necessary and proper” for the carrying out of these enumerated powers.

“To make all Laws which shall be necessary and proper for carrying into Execution the foregoing Powers, and all other Powers vested by this Constitution in the Government of the United States, or in any Department or Officer thereof,” concludes Section 8.

CNSNews.com also asked Hoyer if there is a limit to what Congress can mandate that Americans purchase and whether there is anything that specifically could not be mandated to purchase.

Hoyer said that eventually the Supreme Court would find a limit to Congress’ power, adding that mandates that unfairly favored one person or company over another would obviously be unconstitutional.

“I’m sure the [Supreme] Court will find a limit,” Hoyer said. “For instance, if we mandated that you buy General Motors’ automobiles, I believe that would be far beyond our constitutional responsibility and indeed would violate the Due Process Clause as well – in terms of equal treatment to automobile manufacturers.”

Hoyer said that the insurance mandate was constitutional because Congress is not forcing Americans to buy one particular policy, just any health insurance policy.

“We don’t mandate that they buy a particular insurance [policy] but what we do mandate is that like driving a car -- if you’re going to drive a car, to protect people on the roadway, and yourself, and the public for having to pay your expenses if you get hurt badly – that you need to have insurance,” said Hoyer.

In 1994, the Congressional Budget Office reported the following about health insurance mandates: “A mandate requiring all individuals to purchase health insurance would be an unprecedented form of federal action. The government has never required people to buy any good or service as a condition of lawful residence in the United States.

An individual mandate would have two features that, in combination, would make it unique. First, it would impose a duty on individuals as members of society. Second, it would require people to purchase a specific service that would be heavily regulated by the federal government.”

Under all five of the health care bills currently being considered in Congress, every American adult would have to have a policy that conformed to government standards for coverage and premiums.

Each bill creates Bronze, Silver, and Gold health insurance plans and mandates that Americans buy one of them, either through their employer or through government-run exchanges.

David B. Rivkin, a constitutional lawyer with Baker & Hostetler, told CNSNews.com that Hoyer’s argument was “silly,” adding that if the general welfare clause was that elastic, then nothing would be outside of Congress’ powers.

“Congressman Hoyer is wrong,” Rivkin said. “The notion that the general welfare language is a basis for a specific legislative exercise is all silly because if that’s true, because general welfare language is inherently limitless, then the federal government can do anything.
“The arguments are, I believe, feeble,” he said.

The bipartisan consensus that encourages unaccountable secret state agencies to illegally spy on the American people under color of a limitless, and highly profitable, "war on terror" was dealt a (minor) blow October 13.

Federal District Court Judge Jeffrey White denied a motion by the Obama administration that the court issue a 30-day stay to "release records relating to telecom lobbying over last year's debate over immunity for corporate participation in government spying," the Electronic Frontier Foundation reported.

The Justice Department had argued that the Bush, and now, the Obama administration's Office of Director of National Intelligence (ODNI) and Congress were exempt from releasing lobbying records under the Freedom of Information Act, since consultations amongst said grifters were protected as "intra-agency" records.

One might add, since the 2001 terrorist attacks on New York and Washington, a well-funded surveillance-industrial-complex fueled by giant defense firms and the telecommunications industry have, as investigative journalist Tim Shorrock reported back in 2005 "fielded armies of lobbyists to keep the money flowing."

White's denial of a motion for a stay followed a startling admission by Department of Justice (DoJ) attorneys that America's telecommunication firms are actually "an arm of the government--at least when it comes to secret spying," Wired reported October 8.

The government had argued that:
"The communications between the agencies and telecommunications companies regarding the immunity provisions of the proposed legislation have been regarded as intra-agency because the government and the companies have a common interest in the defense of the pending litigation and the communications regarding the immunity provisions concerned that common interest."
U.S. District Court Judge Jeffery White disagreed and ruled on September 24 that the feds had to release the names of the telecom employees that contacted the Justice Department and the White House to lobby for a get-out-of-court-free card. EFF had sued the state in order to discover what role telecom lobbyists played in persuading Congress to grant the nation's telecommunications' giants retroactive immunity for their role in illegal spying as part of the Bush, and now, Obama regime's Presidential Spying Program.

If congressional grifters who have reaped serious campaign contributions from deep-pocket telecoms had not granted companies such as AT&T, Sprint, Verizon and other carriers retroactive immunity, potential privacy breaches and claims from EFF's Hepting vs. AT&T, and dozens of other lawsuits, could have potentially cost the firms billions in damages.

A federal district court judge dismissed Hepting in June, ruling that the companies had immunity from liability under provisions of the despicable FISA Amendments Act (FAA).

In dismissing the state's motion for a stay in the telecom lobbying records case, EFF senior staff attorney Kurt Opsahl wrote,
On October 8, the day before the documents were due, the DOJ and ODNI filed an emergency motion asking the Court of Appeals for a 30-day stay while the agencies continue to contemplate an appeal. Around noon on October 9, the Ninth Circuit denied their emergency motion, telling the government it had to file for a motion for a stay pending appeal in the district court first.
Later that afternoon, the government filed again in the federal district court, but once again did not seek a stay pending an actual appeal. Instead, for the third time, the government insisted it could delay the release of telecom lobbying records while it considered the pros and cons of appealing. Judge White noted that the Obama administration's cynical "directive on transparency in government" applied to "the warrantless wiretapping program" and insisted that the "public interest lies in favor of disclosure" of pertinent lobbying records.

The ruling is all the more remarkable when one considers that Judge White was appointed to the U.S. District Court, Northern District of California, the most civil liberties' friendly court in the nation, by none other than world class war criminal and corrupter-in-chief, George W. Bush.

Last year, Antifascist Calling reported that the congressional watchdog group, MAPLight, published a list of campaign contributions to congressional Democrats who had changed their votes on FAA's crucial retroactive immunity provision.

Significantly, then congressman and current White House Chief of Staff Rahm Emmanuel, pulled-in some $28,000, "blue dog" Democrat Steny Hoyer "earned" $29,000 while House Speaker Nancy Pelosi, hardly a slouch when it comes to contributions from her "constituents"--grifting capitalists--raked-in $24,500 from the telecoms.

Analyzing the "change of heart" by congressional Democrats between between the March 14, 2008 vote which rejected retroactive immunity and the June 20, 2008 vote approving it, MAPLight researchers discovered that "Verizon, AT&T, and Sprint gave PAC contributions averaging: "$8,359 to each Democrat who changed their position to support immunity for Telcos (94 Dems)" and "$4,987 to each Democrat who remained opposed to immunity for Telcos (116 Dems)."

According to MAPLight: "88 percent of the Dems who changed to supporting immunity (83 Dems of the 94) received PAC contributions from Verizon, AT&T, or Sprint during the last three years (Jan. 2005-Mar. 2008)."

The group reported that after the June 20 vote, "Verizon, AT&T, and Sprint gave PAC contributions averaging (for all House members): "$9,659 to each member of the House voting "YES" (105-Dem, 188-Rep)" and "$4,810 to each member of the House voting "NO" (128-Dem, 1-Rep)."

Daniel Newman, MAPLight's Executive Director said at the time: "Campaign contributions bias our legislative system. Simply put, candidates who take positions contrary to industry interests are unlikely to receive industry funds and thus have fewer resources for their election campaigns than those whose votes favor industry interests."
Proving once again, that ours' is the best Congress money can buy. -
White House Planning "Limited Hangout"

The saga over the release of secret state documents continues to rage out of public sight, even as the corporate media "reports" for endless hours on the (media manufactured) tale of the Colorado "balloon boy."
So corrupt and degenerated has our political culture become that a simple Google search reveals that as of October 17 there are some 15,000,000 search results available for the term "balloon boy" while only 520,000 hits for the term "EFF warrantless wiretapping." -
As Project Censored notes, modern censorship is defined "as the subtle yet constant and sophisticated manipulation of reality in our mass media outlets. On a daily basis, censorship refers to the intentional non-inclusion of a news story--or piece of a news story--based on anything other than a desire to tell the truth. Such manipulation can take the form of political pressure (from government officials and powerful individuals), economic pressure (from advertisers and funders), and legal pressure (the threat of lawsuits from deep-pocket individuals, corporations, and institutions)."

Clearly, the series of lawsuits by EFF and other civil liberties' watchdogs challenging the secret state's pervasive surveillance of the American people is a case study of "intentional non-inclusion" by corporate media.

Nevertheless, the Electronic Frontier Foundation reported October 15, that the Director of National Intelligence and DoJ attorneys "filed yet another emergency motion with the Ninth Circuit, asking for a stay of the deadline to release telecom immunity lobbying documents, less than 24 hours before the documents are due to be released to the public."

According to the government's motion, the Executive Branch has refused to disclose the names of telecom lobbyists and company representatives because, get this, "the agencies ... invoked Exemption 6 [to the Freedom of Information Act] which protects information about individuals whose disclosure 'would constitute a clearly unwarranted invasion of personal privacy'." It doesn't get any cheekier than that even by cynical Washington standards!

DoJ attorneys once again, have resurrected that old chestnut--national security--to conceal the identities of telecom shills and the politicians who do their bidding, claiming that "disclosure of such information would assist our adversaries in drawing inferences about whether certain telecommunications companies may or may not have assisted the government in intelligence-gathering activities."

In other words, the public's right to know how our rights are being systematically violated--and who profits--is, by inference, another "tool" that will allow al-Qaeda to kidnap your kids, impose sharia law and detonate a nuke in Wichita!

Indeed, the secret state's new motion avers that "disclosure of the identities of those individuals and entities that may have assisted, or in the future may assist, the government with intelligence activities could impede the government's ability to gather intelligence information."

Meanwhile, Politico reported that the Obama administration "may be on the verge of a major concession in a long-running legal battle over records about so-called telecom immunity."

A leaked email to the publication, probably by a friendly source inside the White House, reveals that the administration is preparing for "the possible release of some details of the Bush Administration's lobbying for legislation giving telecommunications companies immunity from lawsuits over their involvement in warrantless domestic wiretapping." (emphasis added)

However, the devil as they say, is in those closely-guarded details. Politico reports that the administration will continue its legal battle "to keep secret the identities of the companies involved in the program."

In other words having lost in the court's, the administration will move into damage control mode by disclosing a few insignificant "facts" as it camouflages the scope of these illegal programs and continues to conceal the identities of telecom lobbyists and their congressional partners in crime from public scrutiny.

This is nothing less than an updated version of a classic Washington "limited hangout."

The Obama administration's Justice Department, similar to President Nixon's sacrificial offering of close advisers to congressional investigators at the height of the Watergate scandal, will leverage these paltry "facts" into an opportunity to appear "transparent," even as it continues to obfuscate, delay and deny; thus continuing the cover-up.

House legal counsel Irv Nathan informed relevant congressional committees that the White House Counsel's Office agreed to "provide lawmakers and their staffs with copies of the records being prepared for release in connection with a Freedom of Information Act lawsuit brought by an internet-focused civil liberties group, the Electronic Frontier Foundation."

Politico reported that "the move could also be a litigating tactic to surrender some of the less sensitive information in the case in order to bolster the government's credibility for a determined attempt to protect the most sensitive data: the names of the companies which were seeking immunity."

According to Nathan, the Justice Department plans "to renew its motion for a stay in the Court of Appeals limited to a very small number of documents, not including the communications with Congress."

Among the details leaked to Politico, Nathan wrote House leaders: "We understand that there are few, if any, communications from Members that are in the materials. ... We have been previously advised that there is nothing very disturbing or embarrassing in these particular communications, but a generalized worry about the precedent this sets for future inter-branch communications." (emphasis added)

Unfortunately, neither Mr. Nathan nor Politico have revealed what might prove "very disturbing or embarrassing" to members of Congress in the documents the Obama administration plans to withhold.

If past lobbying practices are a signpost for the present, one can hazard an informed guess and conclude that Congress and their Executive Branch counterparts have much to hide.

According to OpenSecrets.org, AT&T contributed some $8,191,618; Verizon Communications showered some $6,830,000; Qualcomm Inc. handed over $3,080,000; Qwest Communications $1,829,542 and Sprint/Nextel coughed-up some $1,306,000 to "our" representatives. By any standard, this is serious money by powerful constituencies not to be trifled with.

Indeed, the "big four" firms caught-up in the warrantless wiretapping scandal have showered Congress with millions in payouts.

Like their Republican colleagues across the aisle, the Democrats have operated a revolving door between powerful corporations, financial institutions and secret state agencies, under the guise of bringing entrepreneurial expertise into government and "security" for our nation's citizens.
They do neither. -
Something as trivial as the rights of the American people to speak their minds, protest endless imperialist wars of aggression, the looting of the economy and the degradation of the environment for profit will however, continue to come under the lens of an out-of-control national security state committed to facilitating the greasing of various palms well into the future.

It's time we hold the right people accountable, not law-abiding citizens. We are not the problem. It's criminals and the politicians who coddle them.

If you read Part I, II, and III there is no doubt about what our position should be regarding gun laws. However, there are those gun owners that feel real uncomfortable with the notion of no gun control laws at all.

These are folks that are mostly under fifty years of age who probably consider the hoop-jumping a safety issue or just a way of life.
-
These are folks who accept the system for what it is. It may restrict their rights, not allow them to buy the gun they want, but if it keeps criminals from getting guns and makes us safer, it’s worth it they’ll say.

Again, over 20,000 gun laws in this country haven’t kept criminals from getting guns if they want them.

If the gun law system is designed to keep criminals from using it, and it drives them off to an ever-growing black market, what’s the point of having it?

If the only people subject to the process are law-abiding citizens it hardly serves any purpose of keeping guns out of the hands of criminals. It’s simply a terrible waste of law enforcement resources and our hard earned taxes we give the government.

Let’s go through this and add some meat around it so it makes some sense.

Felons
We don’t want felons to buy guns. As a result they don’t use the system law-abiding citizens’ use. Let’s at least be intellectually honest about this issue. Felons get their guns despite government restrictions.

And boy do we have restrictions. Many hours of reading will be required for California’s firearm laws and when finished, you will understand little about firearms restrictions, other than there a lot of them.

You can read the laws on the California DOJ’s website. It is 33 pages long when printed, all implemented to ‘keep us safe.’

After taking a look at it, ask yourself two questions: Do criminals follow these rules? Am I safer knowing that laws exist that are utterly and completely indecipherable by the average college educated person?

Terrorists/Illegal Aliens

The latest nonsense from the anti-gun crowd is that if we don’t restrict access to guns, terrorists will get hold of them. And, illegal immigrants can come to this country and buy guns at will and ship them to who knows where, like Mexico, or use them here to commit crimes. We can’t allow that they say.

Government can be our own worst enemy when it comes to common sense.

You see, terrorists entering this country illegally or people entering the country illegally from around the world, not just Mexico, is an immigration problem, not a gun rights issue.

The government’s lax attitude on this issue should not be a reason to restrict rights of American citizens.
-
Gun owners should demand that our borders be protected. If you are here illegally in possession of a firearm the law should be swift and severe, which we will reviewed later.

If you think that our borders should be open, then please don’t be surprised of the consequences. But your desire to keep the border open should not be cause for Americans to either lose their rights or have them severely restricted. Agreed?

What about nut cases?
-
Well, what about them? Yes, we hear about nut cases going on a rampage every year or two. In virtually all cases these people were allowed to purchase firearms legally.

A number of the shooters we find are on some form of medication prescribed for mental disorders. In most cases they have stopped taking their meds. Millions of people in this country are under care by a licensed doctor and are routinely prescribed anti-depressants. They live a very normal life. When someone goes on a rampage, something else is wrong in that person’s life and brain.

The system fails to catch these people. Does that mean you should jump through hoops and live with restrictions on your right to self-defense because an extreme minority might commit violent acts?
-
Statistically, are many more times likely to be hit by a bolt of lightning before being shot by a shooter on a rampage. You are hundreds of times more likely to go down in a plane crash or killed in an automobile accident.

Let’s not believe that mass shootings are something that happens frequently. They are extraordinarily rare and an unlikely scenario that in no way should justify an entire nation being subject to Second Amendment restrictions.

Restraining Orders
-
In California filing for divorce is all that is required to obtain a restraining order against a spouse. There is no hearing and no evidence. There is no proof required that you are a danger to your spouse.

It’s just another item on the bill of itemized charges a divorce attorney charges the spouse. But, you lose your right to purchase or own a firearm.
-
And it’s not easy getting your guns back after they have been confiscated by local law enforcement.
-
A friend in San Diego, a successful professional with no history of violence and no arrest record, spent five years and a small fortune in legal fees after the divorce was final trying to get his firearms returned to him. That isn’t right. But that’s one of the things law enforcement and legal profession spends its time doing.

The stupid part of all this is that people actually believe they are safe when they have a restraining order out against another person. How many times have we heard about someone killed by a person supposedly under protection of a restraining order? A piece of paper isn’t going to stop anyone. But a gun will.

Unfortunately more often than not the victim is not armed because they can’t get a concealed carry permit in California.

You see, having a restraining order out against an individual is not enough of a reason in most California counties to warrant issuing a permit. Restraining orders are handed out like candy on Halloween in this state.

You would think there would be hundreds-of-thousands with carry permits. Remember, a restraining order does not require evidence, despite what the law might say. It’s just one person who says they are threatened by another.

To obtain a CCW in some communities you must prove that there has been a threat against your life, and in some counties that’s not even enough for a CCW. A restraining order is not generally accepted as a valid reason for a CCW in most locations in California.

We could spend pages going through various ‘what about’ or ‘what if’ scenarios. The possibilities are limitless but anecdotal.

So, what’s next?
-
Look, if we are advocating a complete rollback of gun laws to 1967, there has got to be something that protects citizens from armed criminals other than then a bunch of law-abiding citizens jumping through hoops. We know that doesn’t work.
-
Let’s start with a premise that we live in a free society. We have a Second Amendment which guarantees the right to firearms ownership without infringement.
-
It is a fundamental right, as is freedom of the press, the right to free expression, or the right to assemble. We have the right to be secure in our papers and property from unreasonable search and seizure.
-
These are but some of the fundamental rights that should be maintained with the utmost attention by politicians, law enforcement and the judicial system.
-
When the fundamentals of freedom are violated or abused, not only by government, but individuals as well, the punishment should be swift and sure.
-
A felon (on probation or parole) in possession of a firearm should automatically receive a minimum of 20 years without the possibility of early release.
-
The use of a gun in the commission of a crime should be an automatic sentence of 20 years in prison without the possibility of early release.
-
If you are an illegal alien in possession of a firearm, it’s 20 years in prison. If someone is wounded during the commission of a crime, it’s life in prison with no possibility for parole for the shooter along with all accomplices.

If someone is killed, it’s the death penalty, no exceptions.

The days of murderers on parole need to end. That is nonsense and politicians need to hear from us on this issue loud and clear.

The premise of stiff sentencing is very simple. We remove the burden from the law-abiding and place it on criminals.

What would be the outcome of these ‘draconian’ rules that some might call them? Well, you can be certain a criminal will think twice before using a gun to commit a crime.
-
In fact, with severe sentences like this, it’s a good bet that the majority will forgo using a gun whenever possible. It’s not worth it.
-
And those that do use a gun have violated a basic trust of living in a free society. They don’t deserve the freedom they have been given. But it certainly is not right when the freedoms of all are curtailed for the actions of the few.

As a nation, we should be ashamed that a $1.12 billion agency exists to restrict constitutional rights.

9/6/09 - The roots of the ATF go back to 1789 as the tax collector for imported spirits.

The ATF under different names maintained that primary mission as a tax collector up until around 1968.
-
In 1934 the agency was known as the Alcohol Tax Unit, (ATU) reporting to the Bureau of Internal Revenue (IRS in those days).
-
The ATU spent a brief stint under the FBI during prohibition but was transferred back to the revenue bureau within a few years.
-
Its mission was to collect taxes related to firearms transactions as a result of passage of the Federal Firearms Act in 1934 as well as taxes on alcohol and tobacco.
-
The ATU remained part of the IRS throughout passage of the 1968 Gun Control Act at which time duties of firearm enforcement were added to the unit along with explosives investigations.

In 1970 the Alcohol Tax Unit was renamed the Alcohol, Tobacco & Firearms Division. It is important to note that prior to this time, very little in the way of firearms related investigations were conducted by the ATU.
-
Prior to 1968 virtually no laws existed restricting the transfer of a firearm from person-to-person or dealer-to-person. Hence, no gun laws meant no violations, smuggling, or illegal transfers of firearms. Prior to the Gun Control Act of 1968, the ATF was not much more than a tax collection agency for the IRS.
-
The ATF division remained under control of the IRS until 1972 when it was transferred to the Treasury Department and transitioned from a tax collection agency into a law enforcement agency.

In 2003 ATF was transferred from Treasury to Homeland Security.
-
At the same time Treasury formed the Alcohol, Tobacco Tax and Trade Bureau, while law enforcement duties went to the ATF under Homeland Security.
-
In addition, Homeland Security tacked on the “E” for explosives. The official name of ATF today is the Bureau of Alcohol, Tobacco, Firearms, & Explosives (BATFE).

Two bureaucracies were created out of one.
-
The BATFE has grown at an alarming rate since its inception in 1972.
-
Its 2010 budget request is $1,120,000,000, a $66.5 million increase over 2009. That’s $1.12 billion dollars for an agency whose budget has grown an average of $30 million every year since 1978.
-
72% of its budget is dedicated to firearm regulation enforcement, or over $800,000,000.
-
How much was spent prior to the 1968 Gun Control Act? Not much other than to collect excise taxes in support of the 1934 firearms law. The balance of ATF’s budget is dedicated to alcohol and tobacco enforcement. Despite what we may think, the F portion of ATF is a relatively new function.

For those who say we need the ATF to enforce gun regulations, let’s go back prior to the 1968 Gun Control Act.

If you or I were purchasing a firearm in 1967, we could go to most any Sears store and buy a rifle off the shelf with a minimal amount of paperwork.
-
In essence, it was not more than a receipt for payment of the rifle. If we didn’t feel like going to Sears, we could order it through their catalog and a week or so later it would arrive in the mail. Handgun purchases were not much different.
-
The concept of gun trafficking was unheard of in those days. There were no background checks, no waiting periods, and virtually no restrictions other than on fully automatic firearms as a result of the 1934 restrictions.
-
Firearm thefts from gun stores and homes were rare. Gun related crimes were far below anything we see today, and murder rates were as much 2 to 5 times less than today.

Home invasions weren’t invented yet, neither were car hijackings. Drug use was not widespread and gang related killings were limited to occasional inner city stabbings.

When people talk about the quiet 1960’s, it was going on far longer than before the sixties. The U.S. was a very low-crime country from our very beginning up until the very early 1970s with the exception of during the prohibition on alcohol early last century.

During that time the murder rate spiked as criminal elements fought over control of illegal distribution of alcohol. Sound familiar?
-
The Democrats, in particular Senator Thomas Dodd, heavily promoted the 1968 law as a juvenile crime reduction bill.
-
Then along came gun control laws and restrictions.
-
Thomas Dodd was eventually censured in the Senate for diverting political campaign funds to his personal account, then spending the money.
-
If the name is familiar, he is the father of Senator Chris Dodd, who is also an advocate of limiting gun rights. His father was eventually defeated in 1970 with his seat taken by Lowell Weicker.

And are we better off since GCA-68?
-
Crime statistics would say no. Are we better off with the thousands of gun laws enacted nationwide since GCA-68? Again, the answer would be no. Violent crime rose over the 41-year period without regard to strict gun control laws enacted during that time.
-
So, let’s get rid of the gun laws.
-
The idea of eliminating gun restrictions would seem incredibly outlandish to a significant portion of Americans today. Most have been so conditioned by our government that ownership of guns creates crime, if elimination of gun laws were placed on a referendum for voters, it would likely go down in defeat.
-
Yet, history proves that unrestricted gun rights were quite prevalent for the majority of our history during which we experienced relatively low levels of crime.
-
If gun availability were unrestricted, then criminals would obtain guns. Criminals obtain guns today despite the myriad of restrictions and laws.
-
But what of criminals you ask?
-
If 2% of the population has criminal tendencies, does it make sense to place restrictions on the other 98%?
-
A significant number of felons that are restricted from owning guns are jailed for illegal possession of weapons anyway at some point in their careers. That law doesn’t have to change.
-
What needs to change is the never-ending pursuit of politicians creating laws that frankly do not reduce crime but affects the 98% of the population that aren’t criminals.
-
Politicians have convinced Americans that if they can accept inconvenience, limits, restrictions, and in some cases outright bans, that somehow the 2% that are criminals will end their criminal activities and seek gainful employment.
-
Criminal acts and law-abiding citizens, by definition, are not remotely related to one another. The idea that a criminal will turn over a new leaf because you purchased a firearm legally with a mountain of paperwork, background checks and a waiting period is preposterous on its face.

More-so the notion that banning certain firearms from legal ownership by law-abiding citizens reduces crime is even more ridiculous.
-
If 98% of the population is law-abiding and won’t commit a crime with their firearm, does it stand to reason that preventing them from owning that firearm will reduce crime? Well of course not.
-
The belief that it will reduce crime is driven by anti-gun nonsense that suggests the mere ownership of a firearm will induce a law-abiding citizen to commit a crime. Restrictions on law-abiding citizens have no affect on crime whatsoever.
-
But, what would become of the ATF if firearms were traded, sold and otherwise distributed without restrictions?
-
We do know this. Our government has an insatiable appetite for money.
-
As long as Americans consume alcohol and cigarettes that are taxed far beyond reason, there will be smuggling and trafficking of those items to circumvent the law. The ATF can shrink in size and dedicate the balance of its resources for chasing tax-evading cigarette smugglers and moonshiners until politicians come to their senses and realize that they themselves are the cause of crime, not criminals.

The investigations into bombings and terrorism should go to the FBI where it rightfully belongs.

Will Americans and politicians ever come to their senses on eliminating the labyrinth of gun laws? It’s unlikely.

We unfortunately are byproducts of our environment. Our environment has been filled with crazy propaganda made up of illogical ideas and notions.
-
A famous American once said ‘there’s a sucker born every minute,’ and we have a few million to prove this point. Too many Americans have accepted illogical ideas as fact.
-
If Americans only thought about it for five minutes, they would realize how utterly ignorant they have been. Meanwhile, we gainfully employ 5000 people for $1.12 billion a year at the ATF.

Some demand ever-increasing restrictions on the law-abiding, under the assumption that we need to protect us from ourselves.
-
And, for each law that is created, creates the opportunity for someone to violate the law, increasing crime, therefore increasing expenditures to fight crime, which were not crimes prior to the law. This is not a prescription for common sense. However, we are not known as a nation with common sense when it comes to gun laws.

End the Fear of Your Government
-
As an example, if you plowed around the pro-gun blogs lately, you’ve seen discussion on open-carry. Open-carry advocates walk around with unloaded firearms on their hips in a display of protest for overly restrictive gun rights in California.

The protesters are pointing out the difficulty, and in some communities how impossible it is to obtain a conceal-carry permit. They want CCW laws changed to “shall-issue” like the majority of the states.
-
Well now, does it surprise anyone to read how otherwise pro-gun advocates are saying open-carry demonstrations should be stopped? They are foolish they say. They say if you continue to demonstrate the California legislature will act to eliminate the right.
-
Well, as someone so eloquently put it: ‘What good is a right if you can’t exercise it?’ That’s an outstanding response that is simple to understand. It bears repeating. What good is a right if you can’t exercise it?
-
Despite being “pro-gun” some have vehemently chastised the open-carry demonstrators. Why?
-
It’s fear of the government. They fear their government and the legal retribution that legislators can muster once they are perceived as being mocked or having their noses tweaked by the very laws they created.
-
In other words, they fear punishment from politicians. They feel the need to placate them. They give them a level of respect that defies the fact that they are anti-constitutionalists. The very people they placate don’t believe you have any gun rights.
-
Is that how we should live our lives? Should gun owners live in fear of what politicians might do to us?
-
And what does it matter to gun owners who disagree with the open-carry demonstrators if the legislature passed a law banning it? Those who disagree wouldn’t exercise their right anyway, so they have lost nothing.
-
‘Oh, wait a minute they’ll say.’ It might be a problem in the courts if they ban open-carry in California. I have to laugh at some of these people. Those who will not fight for what is right, live in fear.

The open-carry debate is a classic example of how some gun owners have fallen into the trap of fear.
-
Ending America’s restrictive gun laws is not a prescription for chaos. We’ve proven that for 170 years prior to GCA-68 and the myriad of gun laws implemented since then.
-
We didn’t need the ATF prior to 1972 to enforce gun laws, because we didn’t have any. We focused on the criminals in those days, not the 98% who are law-abiding.
-
Our system of government has degraded from dealing with the exceptions of our society to implementing laws with a ‘one-size-fits-all’ mentality. This is socialism, not a representative republic based on the principle of individual rights.

In this country we are free to succeed, or if we choose, to not succeed. In this country we have a right to choose how we live our lives. We have the right to address our grievances with the government. We have the right to civil discourse and voice our displeasure.

Most importantly, we have the right to change our government and those elements within it that don’t serve our interest of maintaining individual rights.
-
And, each of us has the right to do it individually or as part of a group of like minded citizens.
-
If we are to rebuild this country as it was originally intended, we need to eliminate those laws that infringe on an individual’s right to live as they so desire.
-
That should be the mission of our government. If a law restricts our ability to live out our lives unmolested by government, it does not deserve to be a law.
-
As a nation, we should be ashamed that a $1.12 billion agency exists with almost 75% of its resources dedicated for the purpose of restricting constitutional rights under the guise that it makes us safer as a country. It is an abomination to our Constitution and an affront to our civil rights. It’s time to get the “F” out of ATF.

At a million square feet, the mammoth $2 billion structure will be one-third larger than the US Capitol and will use the same amount of energy as every house in Salt Lake City combined.

Unlike Borges's "labyrinth of letters," this library expects few visitors.
-
It's being built by the ultra-secret National Security Agency—which is primarily responsible for "signals intelligence," the collection and analysis of various forms of communication—to house trillions of phone calls, e-mail messages, and data trails: Web searches, parking receipts, bookstore visits, and other digital "pocket litter."

Lacking adequate space and power at its city-sized Fort Meade, Maryland, headquarters, the NSA is also completing work on another data archive, this one in San Antonio, Texas, which will be nearly the size of the Alamodome.

Just how much information will be stored in these windowless cybertemples?
-
A clue comes from a recent report prepared by the MITRE Corporation, a Pentagon think tank. "As the sensors associated with the various surveillance missions improve," says the report, referring to a variety of technical collection methods, "the data volumes are increasing with a projection that sensor data volume could potentially increase to the level of Yottabytes (1024 Bytes) by 2015."[1]

Roughly equal to about a septillion (1,000,000,000,000,000,000,000,000) pages of text, numbers beyond Yottabytes haven't yet been named.

Once vacuumed up and stored in these near-infinite "libraries," the data are then analyzed by powerful infoweapons, supercomputers running complex algorithmic programs, to determine who among us may be—or may one day become—a terrorist.

In the NSA's world of automated surveillance on steroids, every bit has a history and every keystroke tells a story.
-
In the near decade since September 11, the tectonic plates beneath the American intelligence community have undergone a seismic shift, knocking the director of the CIA from the top of the organizational chart and replacing him with the new director of national intelligence, a desk-bound espiocrat with a large staff but little else.
-
Not only surviving the earthquake but emerging as the most powerful chief the spy world has ever known was the director of the NSA.
-
He is in charge of an organization three times the size of the CIA and empowered in 2008 by Congress to spy on Americans to an unprecedented degree, despite public criticism of the Bush administration's use of the agency to conduct warrantless domestic surveillance as part of the "war on terror."

The legislation also largely freed him of the nettlesome Foreign Intelligence Surveillance Court (FISA). And in another significant move, he was recently named to head the new Cyber Command, which also places him in charge of the nation's growing force of cyber warriors.
-
Wasting no time, the agency has launched a building boom, doubling the size of its headquarters, expanding its listening posts, and constructing enormous data factories.
-
One clue to the possible purpose of the highly secret megacenters comes from the agency's British partner, Government Communications Headquarters. Last year, the British government proposed the creation of an enormous government-run central database to store details on every phone call, e-mail, and Internet search made in the United Kingdom.
-
Click a "send" key or push an "answer" button and the details of the communication end up, perhaps forever, in the government's data warehouse to be scrutinized and analyzed.
-
But when the plans were released by the UK government, there was an immediate outcry from both the press and the public, leading to the scrapping of the "big brother database," as it was called.
-
In its place, however, the government came up with a new plan. Instead of one vast, centralized database, the telecom companies and Internet service providers would be required to maintain records of all details about people's phone, e-mail, and Web-browsing habits for a year and to permit the government access to them when asked.
-
That has led again to public anger and to a protest by the London Internet Exchange, which represents more than 330 telecommunications firms. "We view...the volume of data the government now proposes [we] should collect and retain will be unprecedented, as is the overall level of intrusion into the privacy of citizenry," the group said in August.[2]
-
Unlike the British government, which, to its great credit, allowed public debate on the idea of a central data bank, the NSA obtained the full cooperation of much of the American telecom industry in utmost secrecy after September 11.
-
For example, the agency built secret rooms in AT&T's major switching facilities where duplicate copies of all data are diverted, screened for key names and words by computers, and then transmitted on to the agency for analysis. Thus, these new centers in Utah, Texas, and possibly elsewhere will likely become the centralized repositories for the data intercepted by the NSA in America's version of the "big brother database" rejected by the British.

Matthew M. Aid has been after the NSA's secrets for a very long time. As a sergeant and Russian linguist in the NSA's Air Force branch, he was arrested and convicted in a court-martial, thrown into prison, and slapped with a bad conduct discharge for impersonating an officer and making off with a stash of NSA documents stamped Top Secret Codeword.

He now prefers to obtain the NSA's secrets legally, through the front door of the National Archives. The result is The Secret Sentry: The Untold History of the National Security Agency , a footnote-heavy history told largely through declassified but heavily redacted NSA reports that have been slowly trickling out of the agency over the years. They are most informative in the World War II period but quickly taper off in substance during the cold war.

Aid begins his study on the eve of Pearl Harbor, a time when the entire American cryptologic force could fit into a small, half-empty community theater.
-
But by war's end, it would take a football stadium to seat the 37,000 military and civilian "crippies."
-
On August 14, 1945, as the ink dried on Japan's instruments of surrender, the linguists and codebreakers manning the thirty-seven key listening posts around the world were reading more than three hundred diplomatic code and cipher systems belonging to sixty countries.
-
"The American signals intelligence empire stood at the zenith of its power and prestige," notes Aid. But within days, the cryptanalysts put away their well-sharpened pencils and the intercept operators hung up their earphones. By the end of December 1945, America's crypto world had shrunk to 7,500 men and women.
-
Despite the drastic layoffs, the small cadre of US and British codebreakers excelled against the new "main enemy," as Russia became known.
-
The joint US-British effort deciphered tens of thousands of Russian army and navy messages during the mid-to-late 1940s. But on October 29, 1948, as President Truman was about to deliver a campaign speech in New York, the party was over.
-
In what became known within the crypto world as "Black Friday," the Russian government and military flipped a switch and instantly converted to new, virtually unbreakable encryption systems and from vulnerable radio signals to buried cables. In the war between spies and machines, the spies won.
-
The Soviets had managed to recruit William Weisband, a forty-year-old Russian linguist working for the US Army, who informed them of key cryptologic weaknesses the Americans were successfully exploiting. It was a blow from which the codebreakers would never recover. NSA historians called it "perhaps the most significant intelligence loss in US history."
-
In the 1970s, when some modest gains were made in penetrating the Russian systems, history would repeat itself and another American turncoat, this time Ronald Pelton, would again give away the US secrets.
-
Since then, it has largely been a codemaker's market not only with regard to high-level Russian ciphers, but also those of other key countries, such as China and North Korea. On the other hand, the NSA has made significant progress against less cryptologically sophisticated countries and, from them, gained insight into plans and intentions of countries about which the US has greater concerns.

Thus, when a Chinese diplomat at the United Nations discusses some new African venture with a colleague from Sudan, the eavesdroppers at the NSA may be deaf to the Chinese communications links but they may be able to get that same information by exploiting weaknesses in Sudan's communications and cipher systems when the diplomat reports the meeting to Khartoum.

But even third-world cryptography can be daunting. During the entire war in Vietnam, writes Aid, the agency was never able to break the high-level encryption systems of either the North Vietnamese or the Vietcong. It is a revelation that leads him to conclude "that everything we thought we knew about the role of NSA in the Vietnam War needs to be reconsidered."

Because the book is structured chronologically, it is somewhat difficult to decipher the agency's overall record. But one sees troubling trends.
-
One weakness that seems to recur is that the agency, set up in the wake of World War II to prevent another surprise attack, is itself frequently surprised by attacks and other serious threats.

In the 1950s, as over 100,000 heavily armed North Korean troops surged across the 38th parallel into South Korea, the codebreakers were among the last to know. "The North Korean target was ignored," says a declassified NSA report quoted by Aid.

"North Korea got lost in the shuffle and nobody told us that they were interested in what was going on north of the 38th parallel," exclaimed one intelligence officer. At the time, astonishingly, the Armed Forces Security Agency (AFSA), the NSA's predecessor, didn't even have a Korean-language dictionary.

Unfortunately for General Douglas MacArthur, the codebreakers were able to read the communications of Spain's ambassador to Tokyo and other diplomats, who noted that in their discussions with the general, he made clear his secret hope for all-out war with China and Russia, including the use of nuclear weapons if necessary.

In a rare instance of secret NSA intercepts playing a major part in US politics, once the messages were shown to President Truman, MacArthur's career abruptly ended.
-
Another major surprise came in the 1960s when the Soviet Union was able to move large numbers of personnel, large amounts of equipment, and many ballistic missiles to Cuba without the NSA hearing a peep.
-
Still unable to break into the high-level Soviet cipher systems, the agency was unaware that the 51st Rocket Division had packed up and was encamped in Cuba. Nor did it detect the move of five complete medium-range and intermediate-range missile regiments from their Russian bases to Cuba.

And it had no knowledge that Russian ballistic missiles were on Cuban soil, being positioned in launchers. "Soviet communications security was almost perfect," according to an NSA historian.

The first clues that something unusual was happening had come in mid-July 1962, when NSA analysts noticed record numbers of Soviet cargo and passenger ships heading for Cuba. Analysis of their unencrypted shipping manifests led the NSA to suspect that the ships were delivering weapons.
-
But the nuclear-armed ballistic missiles were not detected until mid-October, a month after their arrival, and not by the NSA; it was the CIA, acting on information from its sources in Cuba and Florida, that ordered the U-2 reconnaisance flight that photographed them at launch sites on the island.

"The crisis," Aid concludes, "was in fact anything but an intelligence success story."

This is a view shared by the agency itself in a candid internal history, which noted that the harrowing events "marked the most significant failure of SIGINT [signals intelligence] to warn national leaders since World War II."

More recently, the NSA was unaware of India's impending nuclear test in 1998, the 1993 attack on the World Trade Center, the attack on the USS Cole in 2000, and the 1998 bombing of two of America's East African embassies.

The agency first learned of the September 11 attacks on $300 television sets tuned to CNN, not its billion-dollar eavesdropping satellites tuned to al-Qaeda.
-
Then there is the pattern by which the NSA was actually right about a warning, but those in power chose to ignore it. During the Korean War, the AFSA picked up numerous indications from low-level unencrypted Chinese intercepts that the Chinese were shifting hundreds of thousands of combat troops to Manchuria by rail, an obvious signal that China might enter the war. But those in charge of Army intelligence simply refused to believe it; it didn't fit in with their plans.

Then, by reading the dispatches between India's well-connected ambassador to Beijing and his Foreign Office, it became clear that China would intervene if UN forces crossed the 38th parallel into North Korea. But again, says Aid, the warning "was either discounted or ignored completely by policymakers in Washington,"

and as the UN troops began crossing the divide, Chinese troops crossed the Yalu River into North Korea. Even when intercepts indicated that the Chinese were well entrenched in the North, officials in Washington and Seoul remained in a state of disbelief, until both South Korean and US forces there were attacked by the Chinese forces.

The pattern was repeated in Vietnam when NSA reporting warned on January 25, 1968, that a major coordinated attack would occur "in the near future in several areas of South Vietnam." But neither the White House, the CIA, nor General William Westmoreland at US military headquarters in Saigon believed it, until over 100,000 North Vietnamese and Vietcong troops launched their Tet offensive in the South five days later on January 30.

"The [NSA] reports failed to shake the commands in Washington and Saigon from their perception," says an NSA history. Tragically, Aid notes, at the end of the war, all of the heroic Vietnamese cryptologic personnel who greatly helped the NSA were left behind. "Many," the NSA report reveals, "undoubtedly perished."

Then again in 1973, as in Korea and Vietnam, the NSA warned that Egypt and Syria were planning "a major offensive" against Israel. But, as Aid quotes an official NSA history, the CIA refused to believe that an attack was imminent "because [they thought] the Arabs wouldn't be 'stupid enough' to attack Israel." They were, they did, and they won.

Everything seemed to go right for the NSA during the Soviet invasion of Afghanistan, which the agency had accurately forecast.

"NSA predicted on December 22 [1979], three full days before the first Soviet troops crossed the Soviet–Afghan border, that the Russians would invade Afghanistan within the next seventy-two hours," writes Aid, adding, "Afghanistan may have been the 'high water mark' for NSA."

The agency also recorded the words of the Russian fighter pilot and his ground controllers as he shot down Korean Airlines Flight 007 in 1983.
-
Although the agency knew that the Russians had accidently mistaken the plane for a potentially hostile US military aircraft, the Reagan administration nevertheless deliberately spun the intercepts to make it seem that the fighter pilot knew all along that it was a passenger jet, infuriating NSA officials.

"The White House's selective release of the most salacious of the NSA material concerning the shootdown set off a firestorm of criticism inside NSA," writes Aid. It was not the first time, nor would it be the last, that the NSA's product was used for political purposes.
-
The most troubling pattern, however, is that the NSA, through gross incompetence, bad intelligence, or deliberate deception through the selective release of information, has helped to push the US into tragic wars.
-
A prime example took place in 1964 when the Johnson administration claimed that two US Navy destroyers in the Gulf of Tonkin, one on an eavesdropping mission for the NSA, were twice attacked by North Vietnamese torpedo boats. Those attacks were then used to justify the escalation of American involvement in the Vietnam War.
-
But Aid cites a top-secret NSA analysis of the incident, completed in 2000, which concluded that the second attack, the one used to justify the war, never took place.
-
Instead, NSA officials deliberately withheld 90 percent of the intelligence on the attacks and told the White House only what it wanted to hear. According to the analysis, only intelligence "that supported the claim that the communists had attacked the two destroyers was given to administration officials."

Not having learned its lesson, in the lead-up to the war in Iraq the NSA again told the administration only what it wanted to hear, despite the clearly ambiguous nature of the evidence.

For years beforehand, the agency's coverage of Iraq was disastrous. In the late 1990s, the Iraqis began shifting much of their high-level military communications from radio to buried fiber optic networks, and at the same time, Saddam Hussein banned the use of cell phones. That left only occasional low-level troop communications.
-
According to a later review, Aid writes, NSA had "virtually no useful signals intelligence on a target that was one of the United States' top intelligence priorities." And the little intelligence it did have pointed away from Iraq possessing weapons of mass destruction.

"We looked long and hard for any signs," said one retired NSA official. "We just never found a 'smoking gun' that Saddam was trying to build nukes or anything else." That, however, did not prevent the NSA director, Lieutenant Gen. Michael V. Hayden, from stamping his approval on the CIA's 2002 National Intelligence Estimate arguing that Iraq's WMDs posed a grave danger, which helped prepare the way for the devastating war.

While much of the terrain Aid covers has been explored before, the most original areas in The Secret Sentry deal with the ground wars in Afghanistan and Iraq, where the NSA was forced to marry, largely unsuccessfully, its super-high-tech strategic capabilities in space with its tactical forces on the ground.

Before the September 11 attacks, the agency's coverage of Afghanistan was even worse than that of Iraq. At the start of the war, the NSA's principal listening post for the region did not have a single linguist proficient in Pashto or Dari, Afghanistan's two principal languages.

Agency recruiters descended on Fremont, California, home of the country's largest population of Afghan expatriates, to build up a cadre of translators—only to have most candidates rejected by the agency's overparanoid security experts.
-
On the plus side, because of the collapse of the Taliban regime's rudimentary communications system, its leaders were forced to communicate only by satellite phones, which were very susceptible to NSA monitoring.

Other NSA tactical teams, Aid explains, collaborated on the ground with Special Forces units, including in the mountains of Tora Bora. But it was a new type of war, one the NSA was not prepared for, and both Osama bin Laden and Taliban leader Mullah Omar easily slipped through its electronic net
-
Eight years later, despite billions of dollars spent by the agency and dozens of tapes released by bin Laden, the NSA is no closer to capturing him or Mullah Omar than it was at Tora Bora in 2001.
-
Disappointingly, the weakest section of the book, mostly summaries of old news clips, deals with what may be the most important subject: the NSA's warrantless eavesdropping and its targeting of American communications.

There is no discussion, for example, of the agency's huge data-mining centers, mentioned above, currently being built in Utah and Texas, or to what extent the agency, which has long been confined to foreign and international communications, is now engaged in domestic eavesdropping.

It is a key question and we have no precise answer. By installing its intercept rooms in such locations as AT&T's main switching station in downtown San Francisco, the agency has physical access to domestic as well as international communications.

Thus it is possible that the agency scans all the e-mail of both and it may also eavesdrop on the telephone calls of both for targets on its ever-growing watch lists.

According to a recent Justice Department report, "As of December 31, 2008, the consolidated terrorist watchlist contained more than 1.1 million known or suspected terrorist identities."[3]
-
Aid's history becomes thin as it gets closer to the present day and the archival documents dwindle, especially since he has no substantial first-person, on-the-record interviews.

Beyond a brief mention, he also leaves other important aspects of the NSA's history unaddressed, including the tumultuous years in the mid-1970s when it was investigated by the Senate's Church Committee for decades of illegal spying; Trailblazer, the nearly decade-long failure to modernize the agency; and the NSA's increasingly important role in cyberwarfare and its implications in future wars.

Where does all this leave us? Aid concludes that the biggest problem facing the agency is not the fact that it's drowning in untranslated, indecipherable, and mostly unusable data, problems that the troubled new modernization plan, Turbulence, is supposed to eventually fix.

"These problems may, in fact, be the tip of the iceberg," he writes. Instead, what the agency needs most, Aid says, is more power. But the type of power to which he is referring is the kind that comes from electrical substations, not statutes.
-
"As strange as it may sound," he writes, "one of the most urgent problems facing NSA is a severe shortage of electrical power."
-
With supercomputers measured by the acre and estimated $70 million annual electricity bills for its headquarters, the agency has begun browning out, which is the reason for locating its new data centers in Utah and Texas. And as it pleads for more money to construct newer and bigger power generators, Aid notes, Congress is balking.

In its top-secret world, the coin of the realm is the kilowatt. More electrical power ensures bigger data centers. Bigger data centers, in turn, generate a need for more access to phone calls and e-mail and, conversely, less privacy. The more data that comes in, the more reports flow out. And the more reports that flow out, the more political power for the agency.

The issue is critical because at the NSA, electrical power is political power.

Rather than give the NSA more money for more power—electrical and political—some have instead suggested just pulling the plug.
-
"NSA can point to things they have obtained that have been useful," Aid quotes former senior State Department official Herbert Levin, a longtime customer of the agency, "but whether they're worth the billions that are spent, is a genuine question in my mind."

Based on the NSA's history of often being on the wrong end of a surprise and a tendency to mistakenly get the country into, rather than out of, wars, it seems to have a rather disastrous cost-benefit ratio.

Were it a corporation, it would likely have gone belly-up years ago.

The September 11 attacks are a case in point. For more than a year and a half the NSA was eavesdropping on two of the lead hijackers, knowing they had been sent by bin Laden, while they were in the US preparing for the attacks.

of us look at the leader of the free world and are frozen in our footsteps,
watching in amazement, as our country’s history of freedom is unraveled
like a ball of yarn. -
The millions of good men and women who gave their
lives for our freedom are not only being taken for granted, but are actually
being looked down upon as if they were part of the problem and the builders
of an evil empire. -
We all think that President Obama is the reason for
the massive attack on our freedom that we are witnessing, but if you really
think deeply about why a perfectly intelligent and even somewhat intellectually
brilliant human being could give away our beloved country with the ease
and confidence of an Acorn employee dishing out advice to a pimp and a
prostitute and not get caught, you would come to understand that President
Obama is just a puppet in a world of deeply distorted demonic power managers. -
These people care nothing about Obama as a person, but only see that he
is the perfect tool to destroy America as we know it! -
A few days ago, I was teaching entrepreneurship to a class of sixth and
seventh graders, and our project was to transform the school into a fair. -
The first lesson they needed to learn was how to run an event. I explained
that they needed to choose a president, vice president, secretary, and
treasurer. -
First, I asked all of the kids who were interested in being
president to gather around me, and I explained what their responsibilities
would entail, telling them they would have to be a good leader and direct
people, as well as organize different committees, etc. Then each one stood
in front of the class and spoke a few words about why they wanted to be
president and what they could do. -
I was sure that this one young man would
be chosen because he was so confident, strong, and had a lot of experience
with making his own money. I just knew he was the one! -
Each student caste
a vote on a slip of paper, and when the votes were counted, to my absolute
shock, the kids had chosen a boy who was silly and had no abilities or
experience, just a cute personality. -
I was
disappointed because I knew that this boy could not do the job, but the
kids were thrilled with their decision. -
This boy had a few friends who
had rallied the other kids in the class to vote for him, and he rose to
power. -
After that, they voted for treasurer, and again, they voted for
the weakest candidate. I was shocked again. -
I talked to my friend who
is the headmistress of this school and asked her how this happened and
why people are so invested in personality and not in character and ability? -
She said something that was so true, “Dianne, the kids who won the
election stand for nothing; they are everyone’s friend and they
are all things to all people. Even though the kids like the boy who they
elected president, he will not make it past his first task!” -
I had
to take a step back and think. I saw what had happened in that classroom
is exactly what had happened in our country’s Presidential election
last fall. -
Candidate Obama had done nothing really clever, and he actually
warned the country that he was going to make some fundamental changes
that would transform America into a new nation, and we sort of heard that
but disbelieved our intuitions’ warnings. -
We need to give a big
“Thank You” to the mainstream media for leading America to
believe that Obama was a middle-of-the-road Democrat. Because they had
an agenda of their own, they never pointed out any of his deceptions but
only his warm, charming qualities and personality. -
Where in the world
are the principled Democrats who will tell the Obama administration that
the President isn’t actually wearing clothes, only make-believe
suits that many of us actually see through. -
Even
though the Obama administration thinks that many of us, including Sarah
Palin, are dumb mobsters who want to make trouble, we are able to see
the simple truth and are not going to allow him to make us, or our kids,
believe that he is fully clothed! -
Many of our elected officials, both
Republicans and Democrats, degrade us daily thinking that we are not aware
of their own lack of clothing. We all see through their pretentious agendas
and the backlash they are witnessing now is not going away. Americans
are acting like true Americans again. -
We will
remind them in upcoming elections not to mess with our freedom, and, oh
yeah, they had better get out of their see-through clothing and put on
the uniform of freedom again with the badge of honor pinned carefully
to their principles, because us multi-tasking, entrepreneurial dads and
moms are about to make some changes and would like to remind our elected
officials that they work for us, and they are going to be fired!

One notable report from the Flaming Gorge Recreation Area in Utah, Wyoming, and near Colorado cited large numbers of Italian men in one cabin and large numbers of French men in another all speaking only in Italian and French .

Also this report included excellent detail of some of these getting on Harley Davidson motorcycles after a Chinook Helicopter passed over the lodge. They were seen riding out to meet the Chinook and receiving something from it which then was taken back to the lodge.

Noticeable were the large numbers of coolers at these respective cabins....perhaps the type that might keep samples of some Virus or Flu cool enough for preservation until samples were to be distributed? Red Canyon just isn't what it may seem these days.

Coincidentally, the tabs those troops are wearing are almost exactly like the tabs we are having made for our upcoming care package initiative, which will put an Oath Keeper tab, DVD, Oath Keepers handbook, copy of the Declaration of Independence and Constitution, and other outreach materials, into the hands of active duty deployed worldwide.

We plan on launching that effort on Veteran’s Day, November 11 and continuing right on through Bill of Rights Day, December 15, with the goal of delivering all the care packages by Christmas. Now imagine what that will be like! Tens of thousands of our troops reached with the message and a tab. I will post more details very soon.
