This American soldier received 110 years to serve in a prison while another soldier in the same group recieved a 100 year jail sentence for participating in the rape crimes on an Iraqi girl. Now if American soldiers are given severe prison penalties for their crimes; would America provide farin justice to the Guitmo "enemy combattants" who were captured by co-alition forces in Afghanistan/Iraw etc.?

The accused ringleader, former Private Steven Green, was discharged from the
Army for a “personality disorder” and is awaiting trial in a civilian court,
where he could face a possible death penalty.
Sergeant Paul Cortez and Specialist James Barker, both of whom admitted to
raping the girl, received life sentences after pleading guilty earlier this
year
“We were expecting the death penalty against those criminals and the place to
carry out the sentence is where the incident happened,” Janabiat’s cousin,
Abu Ammar, told Reuters.

- The depth of involvement in the crimes determines the punishment of the criminals under America's laws. America has the death penalty in some states but not all states. The military laws are seperate laws enforced by the military and with a view od delivering "justice" to all concerned. I'm sorry that some people don't agree with the punishment given these soldiers but 100 or more years with loss of freedom can be more severe to bear than the death sentence. Sadam isn't suffering anymore for the crimes he committed and I wonder if he too, should have received a prison sentence of 100 or more years in jail. Sadam would still be in jail wishing he was executed , I would guess had he not been hung.

Well it took time too iron out the American laws and now a court precedence has been set into place. Rember too, that the Supreme court hardly evere overturns a decision made by the Supreme Court of America.

Finally the terrorist who planned the 911 strike on America will get their day in court , but only if the Supreme Court allows the current court legal structure to be used.

Army Col. Steve David, chief defense counsel for the tribunals, said the military commissions - which the U.S. Supreme Court struck down in 2006 as unconstitutional before they were altered and resurrected months later - are "fundamentally flawed."
The tribunals have been mired in confusion over courtroom rules and dogged by delays.
"We will zealously identify and expose each and every" flaw, he said.
Military commissions have been conducted since George Washington used them after the end of the Revolutionary War, but this is the first time the United States has used them during an ongoing conflict, Hartmann said.
Two weeks ago, Deputy Secretary of State Gordon England declared that providing "fair trials" at Guantanamo is the No. 1 legal services obligation for the Defense Department,

he founding members resolved that the peace of the world must never
again be destroyed by the will and wickedness of any man. We created the United
Nations Security Council, so that, unlike the League of Nations, our
deliberations would be more than talk, our resolutions would be more than
wishes. After generations of deceitful dictators and broken treaties and
squandered lives, we dedicated ourselves to standards of human dignity shared by
all, and to a system of security defended by all.
Our common security is challenged by regional conflicts -- ethnic and
religious strife that is ancient, but not inevitable. In the Middle East, there
can be no peace for either side without freedom for both sides
Had Saddam Hussein been appeased instead of stopped, he would
have endangered the peace and stability of the world. Yet this aggression was
stopped -- by the might of coalition forces and the will of the United Nations.

To suspend hostilities, to spare himself, Iraq's dictator accepted a series
of commitments. The terms were clear, to him and to all. And he agreed to
prove he is complying with every one of those obligations.

He has proven instead only his contempt for the United Nations, and for all
his pledges. By breaking every pledge -- by his deceptions, and by his
cruelties -- Saddam Hussein has made the case against himself.
n 1991, Security Council Resolution 688 demanded that the Iraqi regime
cease at once the repression of its own people, including the systematic
repression of minorities -- which the Council said, threatened international
peace and security in the region. This demand goes ignored.
Tens of thousands of political opponents and
ordinary citizens have been subjected to arbitrary arrest and imprisonment,
summary execution, and torture by beating and burning, electric shock,
starvation, mutilation, and rape. Wives are tortured in front of their
husbands, children in the presence of their parents -- and all of these horrors
concealed from the world by the apparatus of a totalitarian state.
In 1993,
Iraq attempted to assassinate the Emir of Kuwait and a former American
President. Iraq's government openly praised the attacks of September the 11th.
And al Qaeda terrorists escaped from Afghanistan and are known to be in Iraq.
U.N. inspectors believe Iraq has produced two to four
times the amount of biological agents it declared,
s we meet today, it's been almost four years since the last U.N.
inspectors set foot in Iraq, four years for the Iraqi regime to plan, and to
build, and to test behind the cloak of secrecy.
Just months after the 1991 cease-fire, the Security Council twice renewed its
demand that the Iraqi regime cooperate fully with inspectors, condemning Iraq's
serious violations of its obligations. The Security Council again renewed that
demand in 1994, and twice more in 1996, deploring Iraq's clear violations of its
obligations. The Security Council renewed its demand three more times in 1997,
citing flagrant violations; and three more times in 1998, calling Iraq's
behavior totally unacceptable. And in 1999, the demand was renewed yet again.
