Google, authors and publishers recently entered into a
settlement agreement in The Authors Guild et al. v. Google Inc.,
a class action lawsuit brought against Google in connection with its use
of copyrighted books in its Book Search feature, and in The
McGraw-Hill Companies et al. v. Google Inc., a separate lawsuit by
publishers. The settlement, if approved by the court, will provide new
opportunities for authors and publishers to market their works. It will
also enhance the public’s ability to search for books and to get partial
text displays (and, in the case of many older works, full text displays)
at home, at school, and in libraries. At the same time, the settlement
may have significant implications for copyright law, competition,
research and scholarship.

Better Than Owning

The web is also a social common good. The web is not the same as public roads, which are "owned" by the public, but in terms of public access and use, the web is a type of community good. The good of the web serves me as if I owned it. I can summon it in full, anytime, with the snap of a finger. Libraries share some of these qualities. The content of the books are not public domain, but their displays (the books) grant public access to their knowledge and information, which is in some ways better than owning them.

如果中国人是小偷，微软就是大盗

在这次的网络民意的调查中，绝大多数中国人愿意支付200元的正版费给微软，以表示对他们知识产权的尊重。这再一次显示，中国人民是一个伟大的民族。中国人愿意接受所谓现代的版权规则，参与这个知识产权的游戏。只是微软将在国内卖价甚低的软件，在中国卖出了天价（请以收入水平来衡量价格的高低，而不是所谓的国际统一价格），中国人才作出了痛苦的选择——不采购正版。

如果中国人是小偷，微软就是大盗，就是罪犯。不过他非常巧妙地利用了现行法则，也利用了中国政府对游戏规则的不熟悉与不作为。公道自在人心。中国人对微软，愿意支付合理的价格，来作为对其辛苦劳动的报答，但是绝对不会屈服于其商业垄断形成的霸权。中国政府应该在反垄断上挺起腰杆子。欧盟就曾屡次起诉微软，中国政府为什么不敢？

那我们再来看看Amazon的做法，有时实在找不到图片，就去Amazon去搜索，结果发现，Amazon中商品图片没有一张加水印。大站小站一眼就可以辨别出来，大器和小器也一下子就能看透。看完Amazon，再来看看淘宝，只要是有点儿电脑应用知识的，就会把店面装修的让买家眼前一亮，同时商品图片上也都加上了自己的水印。因为淘宝里搜索商品，重复的几率太高，为了防止其他卖家偷窃自己的劳动果实，只好加水印。
