The Registrar of Trademarks has said that Mount Everest Mineral Water cannot register names of mountains as trademarks, dealing a blow to the Tata Group firm in its tussle with Ramesh Chauhan’s Bisleri over the name Himalaya.
Citing the Geographical Indications Act, the office of the Registrar of Trademarks has maintained that names of mountains are not acceptable for registration as trademark for agricultural and natural products.

The Tea Board of India is currently fighting 15 cases in about 10 countries over the violation of certified trademark (CTM) and geographical indication (GI) rules with respect to Darjeeling Tea. The product and the logo were registered as a trademark in 1998 and the GI application was filed in 2003.
“The rulings of some cases have gone against us, mainly because different courts interpret the parameters differently,” said Anindita Ray, the Board’s director of tea promotion.

A company called Delta, also in France, used “Darjeeling” to label its lingerie. Its shops had tealeaves on their entrances as well. “We have filed six cases against them,” Ray added.
UN to support ‘Banarasi sari’ GI
The Secretary General of the United Nations Conference on Trade and Development (UNCTAD) Supachai Panitchpakdi on Friday said that the global body will support the Geographical Indicators (GI) registration of ‘Bhadohi carpet’ and ‘Banarasi sari’.

Kullu cottage industry gets community patent
The industry gets protection under the Geographical Indication of Goods Act, 1999.
Small units of Himachal Pradesh that make handloom woven Kullu shawls and whose products are being copied in the Ludhiana belt finally can get relief, thanks to the Geographical Indication of Goods Act, 1999.
As Kullu shawl is registered under the Geographical Indication(GI) of Goods Act 1999, the Act will prevent manufacturers from outside the state from using the moniker "Kullu shawl".
According to the Act, the locally woven Kullu shawls with the GI mark could use the description "Kullu Shawl" and any other shawl manufactured from places other than the origin could invite penalty up to Rs 2 lakh or imprisonment up to three years or both.
Prior to "Kullu shawls" getting protection under the GI Act, local weavers were facing tough times from powerloom shawls manufactured in Ludhiana that were being sold in the tourist destinations of Himachal Pradesh under the name "Kullu shawl".
The imitations not only flooded the market with cheap and inferior varieties of shawls but also offered huge discounts to tourists.

The crafts are getting registered through the assistance of institutes like ATIRA and National Institute of Fashion Technology (NIFT), Gandhinagar. While ATIRA is acting as a catalyst for bringing Bandhani industry of Jamanagar under GI system, NIFT has been assisting craftsmen of Surendranagar to register Tangaliya craft of weaving.
Once registered, the crafts would get an international recognition which could take them into the fashion industry in Paris and London, said Sankar, adding that the production of Bandhani, which is estimated to be around 60,000 units per annum, could rise up by four times post-GI registration.

NIFT Registrar R K Sharma told Business Standard that the survey and documentation process had already been completed and reports prepared.

"We have completed the documentation for all the major crafts of UP, such as chikan work of Lucknow, Banarasi silk work of Varanasi, brassware of Moradabad and stone carving of Agra," he said.
