CAIR Court Throws Eastern Utility Markets into Financial Tail-Spin
EPA improperly relied upon provisions in the Clean Air Act's (CAA) market-based program that were meant to deal with acid rain, the panel proceeded to vacate completely the EPA's method for allocating emissions allowances to upwind states. This ruling already has had a significant impact on the emissions trading market. Following the decision, the valuation of NOx and SO2 emission credits free fell. Several utilities have already disclosed financial hits in filings with the Securities and Exchange Commission.
Homeowners File Lawsuit Over Wind Turbines
Dr. Todd Stull and his wife Jill say the wind turbines are a ‘nuisance’ and their presence disturbs the enjoyment of their property and their home. The lawsuit against the Allegheny Ridge Corporation and Gamesa Energy was filed Wednesday in the Blair County Court of Common Pleas.
In a stir over wind farms
Two area wind energy opponents filed a lawsuit Monday against the Taylor County Commissioners Court for granting what the plaintiffs say are illegal tax abatements to wind farms developed within the county.
According to the lawsuit, wind energy equipment is not eligible for tax abatements under the state tax code.

Group files appeal to nullify wind farm approval

WELLSBORO — The Tioga Preservation Group has filed an appeal in Tioga County Court to try to block plans to construct a wind farm with more than 120 turbines on Armenia Mountain starting in the spring.
The appeal was filed by the group Jan. 17, asking that the judge “nullify” the preliminary conditional approval granted to AES Armenia Mountain Wind LLC, by the Tioga County Planning Commission Dec. 12, group member Frank Piccolella said.

State court to hear Greenbrier wind power case

State Supreme Court justices this morning will hear arguments over a proposal to build 124 giant wind-power turbines along 23 miles of Greenbrier County ridges.
Local opponents of the Beech Ridge Energy LLC project are appealing the state Public Service Commission’s decision to approve the $300 million development.
Mountain Communities for Responsible Energy argues that the PSC ignored its own permit regulations and did not obtain adequate information about the wind project’s potential impacts before approving it.

Charleston attorney and former Supreme Court justice Richard Neely, representing the plaintiffs in the case, argued to Judge Phil Jordan of the 21st Circuit that Shell should be included in the suit because he has been unable to get information from NedPower or Shell to pursue his case. He said that the suit was originally filed “before the first footer was laid” and NedPower was the entity listed as building the project.

Ruling a setback for wind project

WARREN — A new court ruling will delay the Jordanville Wind project and is raising questions whether the developer might drop the project in southern Herkimer County.
State Supreme Court Justice Donald Greenwood of Onondaga County ruled that the Warren Town Board failed to look closely enough at the project’s potential impact. The town was the lead agency for a state-required environmental review.
The town’s process and decision to approve the review was “arbitrary, capricious and an abuse of discretion,” Greenwood’s decision states.
