Hatch denied, Howard wind case carries on

According to court documents from the Appellate Division, Fourth Judicial Department of New York, the court chose not dismiss an Article 78 lawsuit Tuesday following a motion by Hatch.

According to court documents provided by Arthur Giacalone, an attorney for petitioner Gerry Hedman, the court chose to continue hearing the case and will accept additional filings.

  • Clipper Windpower, a California-based wind turbine manufacturer, is in deep trouble with its top-of-the-line, 2.5-MW Liberty machine, which is experiencing quality control and apparent design problems, and with the company’s financial performance.

Ruling a setback for wind project

  • WARREN — A new court ruling will delay the Jordanville Wind project and is raising questions whether the developer might drop the project in southern Herkimer County.

    State Supreme Court Justice Donald Greenwood of Onondaga County ruled that the Warren Town Board failed to look closely enough at the project’s potential impact. The town was the lead agency for a state-required environmental review.

    The town’s process and decision to approve the review was “arbitrary, capricious and an abuse of discretion,” Greenwood’s decision states.

SCIDA has not provided transparency of their motive of continuous favoritism of UPC Wind. SCIDA must publically disclose the exact amount of fees and financial compensation that will be derived from their approval of this PILOT. Amounts of $100,000 to $600,000 for SCIDA approval of EACH wind project, has been rumored. Why if the amount of power to be sold to the grid is what they portray can they not afford to pay full industrial taxes on the project? CLIPPER WIND TURBINE GEAR FAILURES STOP "STEELWINDS" IN LACKAWANNA , NEW YORK

  • The present gear problems in Lackawanna were, I believe, predictable. In my April 4, 2007 field report on Clipper’s Lackawanna installation I wrote: “My bet is that this complex gear train will have maintenance issues”. And I do not believe the present Clipper gear problems will be fixed by re-manufacturing specific gears or gear teeth or changing gear surface hardness, gear lubrication, etc, etc. - cwwgroup on 2008-01-20
