A leading member of the House Permanent Select Committee on Intelligence has told The Nation that she will launch an investigation into why two Blackwater contractors were among the dead in the December 30 suicide bombing at the CIA station at Forward Operating Base Chapman in Khost, Afghanistan.

"At this time, Blackwater is not involved in any CIA operations other than in a security or support role," CIA spokesman George Little said December 11.

Most of the Blackwater shooters were questioned by State Department Diplomatic Security investigators with the understanding that their statements and information gleaned from them could not be used to bring criminal charges against them, nor could they be introduced as evidence. In other words, "Anything you say can't and won't be used against you in a court of law."

ABC News obtained copies of sworn statements given by Blackwater guards in the immediate aftermath of the shootings, all of which begin, "I understand this statement is being given in furtherance of an official administrative inquiry," and that, "I further understand that neither my statements nor any information or evidence gained by reason of my statements can be used against me in a criminal proceeding."

The issue was that the guards, as government contractors, were obligated to give an immediate report of what they had done, but the Constitution prevents the government from requiring a defendant to testify against himself, so those statements could not be used in a prosecution.

The judge said the prosecutors had failed to take “common sense precautions” to avoid the problem.

Blackwater (Known now as Xe), is a military services private corporation notorious for the massacre committed by its mercenaries in Baghdad. There is a lot more about Blackwater than what catches the eye. I think of the corporations all that is to know about it as a means for looking into the abys...
