CEBU CITY -- Cebu businessman Victor Jose "Jojo" Uy sent separate letters to Senate President Aquilino Pimentel Jr. and Chief Justice Hilario Davide Jr. denying that he is Eleuterio Tan.

He also expressed his willingness to testify if called by the impeachment court to clear his name.

This will put an end to allegations that he is Eleuterio Tan, who encashed P90-million checks at the Land Bank of the Philippines Shaw Blvd. branch.

"As I said I am not Eleuterio Tan. If the bank officials will insist that I am the one, then let it be, but I will testify. I have never been to that bank on Aug. 28, 1998," Uy said.

At the impeachment hearing yesterday, Caridad Rodenas, LBP Shaw Blvd. branch cashier, said she could identify Tan, who came with Delia Rajas and Alma Alfaro to cash in the checks.

"He's the kind of man who leaves a lasting impression," a half-smiling Rodenas told the impeachment court.

She also admitted that she was attracted to Tan who appeared "guapo (handsome), very neat and very fair."

Tan presented two company IDs with Uy's photos.

During Senate Blue Ribbon Committee hearings on the bribery and corruption allegations against President Estrada, Senate President Aquilino Pimentel revealed that Tan's ID photos matched those of Uy's in his LTO-issued driver's license.

Uy informed Pimentel and Davide that he filed a P5-million damage suit against Tan before the Cebu Regional Trial Court because his good name was besmirched.

The P90 million was part of the P130 million tobacco excise taxes of Ilocos Sur, which Gov. Luis Singson said was diverted to the President's personal funds.

Lawyer Carlynn Carrillo-Posadas, Cebu Regional Trial Court Branch 12 clerk of court, said summons for Tan has been issued but it is yet to be served.

The court has ordered Tan, whose address in court records is Solid Builders GCCC in Libertad, Mandaluyong, to answer the complaint filed by Uy 15 days upon receipt of the document.

Uy has been in Manila for two weeks now. He went home to Cebu Saturday night but left again Sunday to meet with his lawyers.

He admitted that he is among the original incorporators of Power Management Consultancy of Charlie "Atong" Ang, which entered an agreement of the Philippine Amusement and Gaming Corp. to operate Bingo-2 Ball. But he left the firm long before it operated Bingo-2 Ball, which was aimed to replace jueteng.

Both Uy and Ang are friends of President Estrada.
